A RESOLUTION OF THE MIAMI CITY COMMISSION URGING GOVERNOR RICK SCOTT
AND THE FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT") TO HONOR THE
COMMITMENT TO PROVIDE A "SIGNATURE" BRIDGE DESIGN FOR 1-395, EXPRESSING
THE CITY OF MIAMI'S SUPPORT FOR A SIGNATURE BRIDGE; AND FURTHER OPPOSING
ANY EFFORTS BY FDOT TO DIMINISH THE DESIGN OF 1-395 AGAINST THE EXPRESSED.
NEEDS AND WISHES OF THE COMMUNITY; DIRECTING THE CITY CLERK TO TRANSMIT
A COPY OF THIS RESOLUTION TO THE ELECTED OFFICIALS STATED HEREIN.

BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The Miami City Commission urges Governor Rick Scott and the Florida
Department of Transportation to honor the commitment to provide a "signature" bridge design
for 1-395.
Section 2. The Miami City Commission supports the design for a "signature" bridge
and further opposes any efforts by the Florida Department of Transportation ("FDOT") to
diminish the design of 1-395 against the expressed needs and wishes of the community.
Section 3. A Project Advisory Group ("PAG") was established consisting of
members of the public, and at the conclusion of the extensive Public Involvement Program
("PIP") and the issuing of the Draft Environmental Impact Statement ("DEIS"), the detailed
evaluation methodology and public input showed that the "Signature" Bridge Alternative (#3)
was the preferred option.
Section 4. A number of Commitments were made as part of the February 18, 2010
Final Environmental Impact Statement (FEIS) and the July 16, 2010 1-395 Reconstruction
Record of Decision including the FDOT's commitment to provide a "Signature" bridge design
(See Exhibit A).
Section 5. Per the FDOT 1-395 Roadway Project Fact Sheet (Project Identification
number: 251688-1-52-01), the preliminary design phase of the 1-395 roadway project began in
June 2011 to develop the proposed improvements that included "creating a visually appealing
bridge" (See Exhibit B).
Section 6. The preliminary design phase continued the public involvement effort by
reestablishing a PAG and convening three meetings over a period of one and a half years.
Section 7. On September 12, 2012 fifteen (15) "signature" bridge alternatives were
presented to the PAG at its second meeting and the top three alternatives were selected for
further development.
Section 8. At the same meeting, FDOT informed the PAG that the project's
Technical Advisory Committee ("TAC") had requested that two additional "non -signature"
bridge alternatives be added to the study and the PAG expressed opposition to the inclusion of
these last minute alternatives.
Section 9. The November 16, 2012 1-395 Reconstruction Project Visual Quality
Manual (VQM) included the three PAG selected "signature" bridge alternatives along with a
TAC requested "non -signature" bridge alternative.

Section 10. At the January 23, 2013 PAG meeting, FDOT presented two further
developed PAG selected "signature" bridge alternatives and two "non -signature" bridge
_ alternatives requested by the TAC.
Section 11. The above -referenced FEIS states that "environmental justice is to be
achieved through consistent strategies that ensure meaningful participation by the affected
community in the decision making process".
Section 12. The City of Miami, Miami -Dade County, the State of Florida and private
entities have invested deeply in the immediate area that would be impacted by the bridge
including the Overtown Neighborhood, the Performing Arts Center, Science Museum, Art
Museum, Museum Park, Port of Miami Tunnel, and several planned developments.
Section 13. The Miami City Commission finds that this long-awaited transportation
improvement is critical to the future of Miami and that any breach of those promises made to
the community will constitute a violation of Federal environmental justice policy having an
adverse human health and environmental effect on the community.
Section 14. The City Clerk is directed to transmit a copy of this Resolution to
Governor Rick Scott and the members of the Florida State Legislature.
Section 15. This Resolution shall become effective immediately upon its adoption
and signature of the Mayor. {1}

{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by the City Commission.
