HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13-00185 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE PROCUREMENT OF STRUCTURAL FIRE FIGHTER PROTECTIVE CLOTHING, FROM MUNICIPAL EMERGENCY SERVICES, INC., UTILIZING AN EXISTING NATIONAL PURCHASING PARTNERS ("NPP") D/B/A FIRERESCUE-GPO CONTRACT, FOR STRUCTURAL FIRE FIGHTER PROTECTIVE CLOTHING, CONTRACT # 804, EFFECTIVE THROUGH JULY 31, 2014, SUBJECT TO ANY FURTHER RENEWALS, EXTENSIONS OR REPLACEMENT CONTRACTS BY FIRERESCUE-GPO, FOR THE DEPARTMENT OF FIRE -RESCUE, TO BE UTILIZED BY VARIOUS CITY OF MIAMI ("CITY") DEPARTMENTS AND AGENCIES, ON AS -NEEDED CONTRACTUAL BASIS, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED; FURTHER ACKNOWLEDGING THE COOPERATIVE PROCUREMENT BENEFITS OF THE NPP PROGRAM THAT ENABLES THE CITY TO AGGREGATE ITS PURCHASING VOLUME WITH THAT OF OTHER PARTICIPATING AGENCIES IN ORDER TO REALIZE A LARGER PERCENTAGE DISCOUNT PRICING STRUCTURE TO THE FINANCIAL BENEFIT OF THE CITIZENS OF THE CITY; FURTHER AUTHORIZING PIGGYBACKS OF OTHER AND FUTURE COOPERATIVE NPP D/B/A FIRERESCUE-GPO CONTRACTS, WITHOUT ADDITIONAL CITY COMMISSION AUTHORIZATION UPON DETERMINATION BY THE CHIEF PROCUREMENT OFFICER THAT SAID PIGGYBACKS ARE IN COMPLIANCE WITH SECTION 18-111 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARYAPPROVALAT THE TIME OF NEED. WHEREAS, the City of Miami's ("City's") Department of Fire -Rescue was in need of completing an initial $50,000 purchase of Structural Fire Fighter Protective Clothing for a new recruit class that began September 25, 2012; and WHEREAS, National Purchasing Partners ("NPP") d/b/a FireRescue GPO, owned by non-profit Virginia Mason Medical Center, is a group purchasing organization offering access to competitively procured contracts; and WHEREAS, membership with the FireRescue GPO is free and voluntary without any purchasing obligations; and WHEREAS, Tualatin Valley Fire and Rescue, Colorado, in conjunction with FireRescue GPO, served as the Lead Agency to solicit proposals from Structural Fire Fighter Protective Clothing providers to service Tualatin Valley Fire and Rescue and FireRescue GPO membership; and WHEREAS, the published Request for Proposals ("RFP") by Tualatin Valley Fire and Rescue contained provisions that permitted all members of FireRescue GPO throughout the nation to piggyback off the resulting Master Price Agreement; and City of Miami Page 1 of 3 File Id: 13-00185 (Version: 1) Printed On: 2/19/2013 File Number: 13-00185 WHEREAS, pursuant to Section 18-111 of the Code of the City of Miami, Florida, as amended ("City Code"), the Chief Procurement Officer determined that the FireRescue GPO contract for Fire Fighter Protective Clothing was entered into pursuant to a competitive process in compliance with the City laws, policies, and procedures; and WHEREAS, pursuant to Section 18-111 of the City Code, the City Manager signed a Member Intergovernmental Cooperative Purchasing Agreement with NPP d/b/a FireRescue GPO and approved a purchase exceeding $25,000, but less than $50,000 with Municipal Emergency Services, Inc., in order for the Department of Fire -Rescue to buy Structural Fire Fighter Protective Clothing for the new recruit class; and WHEREAS, it is now requested of the City Commission that a resolution be adopted enabling the Department of Fire -Rescue and other various City Departments and Agencies to continue to purchase goods/services, as needed, from FireRescue GPO competitively solicited contracts, subject to budgetary approval and availability of funds at the time of need; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The procurement of Structural Fire Fighter Protective Clothing, from Municipal Emergency Services, Inc., utilizing. an existing NPP d/b/a FireRescue-GPO contract, for Structural Fire Fighter Protective Clothing, Contract # 804, effective through July 31, 2014, subject to any further renewals, extensions and/or replacement contracts by FireRescue-GPO, for the Department of Fire -Rescue, is authorized, to be utilized by various City Departments and Agencies, on as -needed contractual basis, subject to the availability of funds and budgetary approval at the time of need. Section 3. The cooperative procurement benefits of the NPP program that enables the City to aggregate its purchasing volume with that of other participating agencies in order to realize a larger percentage discount pricing structure to the financial benefit of the citizens of the City are acknowledged. Section 4. The piggybacks of other and future NPP d/b/a FireRescue-GPO contracts without any further City Commission authorization upon determination by the Chief Procurement Officer that said piggybacks are in compliance with Section 18-111 of the City Code, subject to the availability of funds and budgetary approval at the time of need, are authorized. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
