ANALYSIS FOR ZONING CHANGE
Northern portion of a vacant irregularly shaped property located within
the block bounded by Florida Ave on the North, Plaza St. on the East,
Grand Ave on the South, and Douglas Ave on the West

Pursuant to Article 5 and Article 7, Section 7.1.2.8 of Ordinance 13114, as amended, the Zoning Ordinance
of the City of Miami, Florida, the subject proposal has been reviewed for an amendment to the Zoning Atlas
as follows:
Application requests:
The request is to change the zoning classifications from "Sub -Urban Transect Zone — Restricted" T3-R with
"Neighborhood Conservation Districts — 2" NCD-2 overlay to "General Urban Transect Zone -Open" T4-0
with NCD-2 for the North portion of the property identified with the Folio Number: 01-4121-007-3850,
fronting Plaza Street and Florida Avenue.
The subject property is located within the Southwest Coconut Grove NET area, and consists of two
contiguous parcels unified in one folio number comprising a total of approximately 1.194 acres, that is
approximately 52,000 s.f, The property, irregularly shaped, is fronting North to Florida Avenue, East to
Plaza Street, and South to Grand Avenue (Complete legal description is on file with the Hearing Boards
Section).
Review and analysis of the proposed application finds that:
• The subject property is comprised of a total of approximately 1.194 acres, that is approximately
52,000 s.f. and has two zoning designations as follow:
o North portion consists of approximately 25,000 s.f. of vacant land designated with "Sub
Urban Transect Zone - Restricted" T3-R zoning designation with a "Neighborhood
Conservation Districts — 2" NCD-2 overlay district, and
o South portion which is designated with "Urban Center Transect Zone - Open" T5-0 zoning
designation with a "Neighborhood Conservation Districts — 2" NCD-2 overlay district.
• The Miami Comprehensive Neighborhood Plan designates the northern portion "Single Family
Residential", and the southern portion with "Restricted Commercial" which are consistent with the
current zoning designation for each portion.

• The north portion of the subject property, as presented is consistent with the residential character
of Florida Avenue, while the southern portion, facing Grand Avenue, as described is consistent with
the current T5-0 transect.
• The south portion as described is also part of the designated "Grand Avenue Vision Plan" which
was created to guide the redevelopment along this important neighborhood "main street" corridor
thru the Village West Coconut Grove community. This plan is a consensus document supporting
the neighborhood's inherent virtues, cultural character, historical precedent and need for
redevelopment.
• Change the zoning designation to the northern portion will require a FLUM amendment to the
Miami Comprehensive Neighborhood Plan to "Low Density Restricted Commercial" as companion
Item.
• The zoning change requested to T4-0 is required by the applicant in order to comply with
Section 3.3.1 of Miami 21 Code which limits the access from T5 through the T4-0 zoned property
rather than T4-R or T4-L.
• The zoning change requested is not supported with a project showing the preservation of
characters of Grand and Florida Avenue respectively, for that reason its approval would set
precedents of commercial intrusion in a well established residential neighborhood.
Based on the aforementioned findings, the Planning and Zoning Department recommends denial of
the application as presented.

Re: Re -Zoning and Comprehensive Plan Applications for Florida Avenue
Properties; Letter of Intent and Analysis of Properties Within One -Half Mile
Radius
Dear Mr. Rodriguez:
On behalf of the Theodore Roosevelt Gibson Memorial Fund, Incorporated, we hereby
file the attached applications for re -zoning and comprehensive plan change for the property
located at approximately 3642 Florida Avenue and legally described in the attached Exhibit "A"
(the "Property"). The purpose of the applications is to enable the use of the Property as
additional housing and surface parking in connection with the development of the adjacent T5 0
property fronting Grand Avenue which is to be improved with a multifamily building providing
income -verified elderly housing and a ground floor community/educational facility which will be
operated in partnership with the University of Miami. The development will be accomplished
through the joint participation of the owner and the Coconut Grove Collaborative, a not for profit
entity, with financing provided by General Obligation Bond funds allocated by County
Commissioner Xavier Suarez. A sketch of the proposed site is attached as Exhibit "A" to this
letter.

The Property consists of an approximately 25,000 square feet vacant lot. It contains
approximately 200 feet of frontage on Florida Avenue and is therefore eligible for re -zoning
pursuant to Section 7.1.2.8.c of Miami 21. The vacant lot is clearly underutilized.
The Property is currently zoned T3-R and NCD-2 Village West Island and Charles
Avenue Neighborhood Conservation and is designed Single Family Residential in the
Comprehensive Neighborhood Plan. This application seeks a change to T4-O and NCD-2
Village West Island and Charles Avenue Neighborhood Conservation District and a Low Density
Restricted Commercial Designation. The requested Comprehensive Plan designation is
necessary to obtain the T4-O designation. The T4-O zoning is necessitated by Section 3.3.1 of
Miami 21 which limits access to T5 development only through T4-O zoned property rather than
T4-R or T4-L. The NCD-2 Village West Island and Charles Avenue Neighborhood
Conservation District zoning will remain as currently in place.
Notwithstanding the zoning being sought, the applicants wish to commit the Property to
be developed in accordance with the above -described proposal and will be submitting a
Declaration of Restrictions tying development of the Property to a site plan. The site plan calls
for four 3-unit pods along the Florida Avenue frontage oriented so as to only have one unit in
each pod face Florida Avenue. This will ensure a look and feel of single family residential is
experienced from the public realm of Florida Avenue. South of the residential pods, the balance
of the Property will be developed as surface parking and a driveway from Plaza Street on the east
boundary. The adjacent property to the south will be developed with the aforementioned elderly
housing and community/educational center building.
In analyzing the surrounding area within a one-half mile radius, it is immediately
apparent that T5 extends northward of the rear lot line of lots fronting Grand Avenue both to the
east, on the adjacent block, and to the west, on the same block, of the subject property. Further,
T4-O exists on the parcels fronting Florida Avenue on several blocks further to the east. In other
words, the proposed zoning is consistent with the trend of zoning in the area, and when
developed as proposed above, is compatible with the surrounding neighborhood. Moreover, the
proposed 3-unit pods provide an appropriately scaled transition of height, intensity, and density
between the more intensive development on Grand Avenue and the single family residential
neighborhood to the north.
The requested re -zoning and comprehensive plan change, as circumscribed by the site
plan, is compatible with the area and consistent with the Comprehensive Plan which encourages
"redevelopment and revitalization of blighted, declining, or threatened" areas through public -
private redevelopment initiatives. See Objective LU-1.2. Policy LU-1.1.11 supports giving
priority to infill development on vacant parcels. Finally, Policy LU-1.1.7 emphasizes the
importance of a well -designed mix of uses that pair residential with other uses, including
community facilities. These applications will provide for infill development that provides a

neighborhood.

Zoning and Appeals Board and the City Commission. The application submittal date is the
date stamped by Hearing Boards' staff on this page. The responses to this application must
be typed and signed in black ink. All pertinent and accurate information/documentation; i.e.,
the plans, reports, exhibits, shall be presented at the time of filing, in addition to the paid receipt.

DECLARATION OF RESTRICTIONS
WHEREAS, the undersigned Owner holds the fee simple title to the land in Miami -Dade
County, Florida, described in Exhibit "A," attached hereto, and hereinafter called the "Property,"
and
IN ORDER TO ASSURE the City that the representations made by the Owner during
consideration of a change of zoning and comprehensive plan designation from T3-R "Sub -Urban
Zone" and NCD-2 "Village West Island and Charles Avenue Neighborhood Conservation
District" to T4-O "General Urban Zone" and NCD-2 "Village West Island and Charles Avenue
Neighborhood Conservation District" for the property legally described in the attached Exhibit
"A" (the "Property") will be abided by, the Owner freely, voluntarily and without duress makes
the following Declaration of Restrictions covering and running with the Property:
(1)
Notwithstanding the T4-O and NCD-2 zoning, the Owner will restrict the Property to
those uses allowed in the T4-R transect, and all parking and vehicular access, ingress,
and egress allowed in the T4-O transect.
City Inspection. As further part of this Declaration, it is hereby understood and agreed
that any official inspector of the City of Miami, or its agents duly authorized, may have
the privilege at any time during normal working hours of entering and inspecting the use
of the premises to determine whether or not the requirements of the building and zoning
regulations and the conditions herein agreed to are being complied with.
Covenant Running with the Land. This Declaration on the part of the Owner shall
constitute a covenant running with the land and shall be recorded, at Owner's expense,
within thirty (30) days of acceptance by the City of Miami in the public records of
Miami -Dade County, Florida and shall remain in full force and effect and be binding
upon the undersigned Owner, and their heirs, successors and assigns until such time as
the same is modified or released. These restrictions during their lifetime shall be for the
benefit of, and limitation upon, all present and future owners of the real property and for
the benefit of Miami -Dade County and the public welfare. Owner, and their heirs,
successors and assigns, acknowledge that acceptance of this Declaration does not in any
way obligate or provide a limitation on the City of Miami.
Term. This Declaration is to run with the land and shall be binding on all parties and all
persons claiming under it for a period of thirty (30) years from the date this Declaration is
recorded after which time it shall be extended automatically for successive periods of ten
(10) years each, unless an instrument signed by the, then, owner(s) of the Property has

been recorded agreeing to change the covenant in whole, or in part, provided that the
Declaration has first been modified or released by the City of Miami.
Modification, Amendment, Release. This Declaration of Restrictions may be modified,
amended or released as to the land herein described, or any portion thereof, by a written
instrument executed by the, then, owner(s) of all of the Property, including joinders of all
mortgagees, if any, provided that the same is also approved by the City of Miami
Commission, after public hearing. Any modification, amendment or release shall be in a
form acceptable to the City Attorney.
Should this Declaration of Restrictions be so modified, amended or released, the Director
of the City of Miami Department of Planning and Zoning, or the executive officer of the
successor of such Department, or in the absence of such director or executive officer by
his assistant in charge of the office in his absence, shall forthwith execute a written
instrument effectuating and acknowledging such modification, amendment or release.
Enforcement. Enforcement shall be by action against any parties or person violating, or
attempting to violate, any covenants. The prevailing party in any action or suit pertaining
to or arising out of this declaration shall be entitled to recover, in addition to costs and
disbursements allowed by law, such sum as the Court may adjudge to be reasonable for
the services of his attorney. This enforcement provision shall be in addition to any other
remedies available at law, in equity or both. Attorneys fees may not be awarded against
the City of Miami under this Section.
Authorization for City of Miami to Withhold Permits and Inspections. In the event
the terms of this Declaration are not being complied with, in addition to any other
remedies available, the City is hereby authorized to withhold any further permits, and
refuse to make any inspections or grant any approvals, until such time as this declaration
is complied with.
Election of Remedies. All rights, remedies and privileges granted herein shall be
deemed to be cumulative and the exercise of any one or more shall neither be deemed to
constitute an election of remedies, nor shall it preclude the party exercising the same
from exercising such other additional rights, remedies or privileges.
Permissive Presumption of Compliance. Where construction has occurred on the
Property or any portion thereof, pursuant to a lawful permit issued by the City, and
inspections made and approval of occupancy given by the City, then such construction,
inspection and approval shall create a permissive presumption that the buildings or
structures thus constructed comply with the intent and spirit of this Declaration. This
presumption shall be classified as a rebuttable presumption under Florida Law.
Severability. Invalidation of any one of these covenants, by judgment of Court, shall not
affect any of the other provisions which shall remain in full force and effect. However, if
any material portion is invalidated, the City shall be entitled to revoke any approval
predicated upon the invalidated portion

Recording. This Declaration shall be filed of record in the public records of Miami -
Dade County. The City of Miami shall be furnished a recorded copy within 30 days of
recordation and the Owner must promptly furnish a certified copy of the recorded
covenant to the City of Miami Zoning Administrator at 444 SW 21 Avenue, Miami,
Florida 33130.
Acceptance of Declaration. Acceptance of this Declaration does not obligate the City
in any manner, nor does it entitle the Owner to a favorable recommendation or approval
of any application, zoning or otherwise, and the City Commissioners and/or any
appropriate City Board retain its full power and authority to deny each such application
in whole or in part and to decline to accept any conveyance.
Owner. The term Owner shall include the Owner, and its heirs, successors and assigns.
