Subject: A Resolution authorizing the City Manager to execute a Release, Waiver of Liability, Hold
Harmless Agreement and Covenant Not to Sue
Purpose of Item:
A Resolution authorizing the City Manager to execute a Release, Waiver of Liability, Hold Harmless
Agreement and Covenant Not to Sue with the Florida Power and Light Company to install and
maintain LED roadway lighting on roadways under the jurisdiction of the City of Miami.
Background Information:
The City desires, and FPL agrees to implement a LED Roadway Lighting Pilot Program on
McDonald Street (SW 32 Avenue), a City maintained roadway, between US 1 and Grand Avenue.
The program will replace the existing street light fixtures and lamps with the latest LED lighting
fixtures from General Electric. The use of this lighting system, however, is new to the City of Miami
and FPL has requested that the City, as broad as possible, indemnifies and holds FPL harmless against
claims regarding the LED lighting in the case of litigation. The attached agreement has been reviewed
by the City Attorney's Office.
