HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American • Drive Miami, FL 33133 www.miamigov.com File Number: 12-01336 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE THE SECOND AMENDMENT TO THE INTERLOCAL AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND MIAMI-DADE COUNTY ("COUNTY") AND CONTRACT CITIES FOR USE OF THE COUNTY SOLID WASTE MANAGEMENT SYSTEM FOR SOLID WASTE DISPOSAL OF MUNICIPAL SOLID WASTE. WHEREAS, the Miami -Dade County Board of County Commissioners finds and declares that it is necessary to the health, safety and welfare of the citizens of Miami -Dade County ("County") to provide for municipal solid waste disposal and management facilities and services; and WHEREAS, the County desires to maximize the use of its Resources Recovery facility processes and to extend the life of its landfills; and WHEREAS, the City of Miami ("City") desires to use the County Solid Waste Management System for its municipal solid waste disposal needs (and transfer needs, as applicable), at an agreed -upon disposal fee rate (and transfer fee rate as applicable); and WHEREAS, the City desires to use the County Solid Waste Management System to satisfy Concurrency requirements of the Local Government Comprehensive Planning and Land Development Regulation Act (Chapter 163, Part II, Florida Statutes) only as it applies to disposal capacity for municipal solid waste the City collects for disposal and which is committed to the County for disposal in the County Solid Waste Management System in accordance with the agreement, and actually disposed of therein; and WHEREAS, by the Second Amended and Restated Interlocal Agreement ("Agreement"), attached and incorporated, the County and the City desires to clarify the conditions under which Contract Cities may use the Waste Management Inc. of Florida landfill in Medley, Florida; and WHEREAS, the County and the City desire to formalize their relationship regarding municipal solid waste disposal responsibilities consistent with the provisions of Section 403.706 of Florida Statutes; and WHEREAS, the County and the City wish to enter into the Agreement; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings found in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. The City Manager is authorized{1} to execute an Agreement, in substantially the attached form, between the City and the County for the use of the County Solid Waste Management System for solid waste disposal of municipal solid waste. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AN I. ORRECTNESS: JULIE O. BRU CITY ATTORNEY' 1' Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
