A RESOLUTION OF THE MIAMI CITY COMMISSION, DETERMINING THAT THE
CONDITIONS SET FORTH IN SECTION 111.065(3), FLORIDA STATUTES, HAVE
NOT BEEN SATISFIED, DECLINING TO AUTHORIZE THE EXPENDITURE OF
ATTORNEY'S FEES AND COSTS FOR THE ENGAGEMENT OF CRIMINAL
DEFENSE COUNSEL FOR REPRESENTATION OF SERGEANT RAUL IGLESIAS
IN THE CASE OF UNITED STATES OF AMERICA VS. RAUL IGLESIAS, PENDING
IN THE UNITED STATES DISTRICT COURT, SOUTHERN DISTRICT OF
FLORIDA, CASE NOS.: 12-CR-20533-CMA AND 12-CR-20533-CMA-1; FURTHER
PROVIDING FOR A RETROACTIVE DATE.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. After considering the request for legal representation submitted by Sergeant Raul
Iglesias, dated December 26, 2012, and after further considering the conditions set forth in Section
111.065(3), Florida Statutes, the satisfaction of which are prerequisite to the City of Miami's ("City")
authorization to provide legal representation to a police officer in a criminal case, it is determined that
the conditions set forth in Section 111.065(3), Florida Statutes, have not been satisfied, and that the
expenditure of attorney's fees and costs for the engagement of criminal defense counsel for
representation of Sergeant Raul Iglesias in the case of United States of America vs. Raul Iglesias,
pending in the United States District Court, Southern District of Florida, Case Nos. 12-cr-20533-CMA
and 12-cr-20533-CMA-1, is not authorized, and is therefore declined.
Section 2. This determination shall be effective retroactively to December 26, 2012, the date
Sergeant Raul Iglesias first submitted a request for representation to the City.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1}
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
