CLOSING, VACATING, ABANDONING AND DISCONTINUING FOR PUBLIC USE AN ALLEY
LOCATED BETWEEN NORTHEAST 27th STREET AND NORTHEAST 28th STREET FROM
APPROXIMATELY 700 FEET EAST OF BISCAYNE BOULEVARD TO BISCAYNE BAY
Pursuant to Section 55-15 (c) of the Miami City Code, the Planning Department has
reviewed the proposed public right-of-way vacation and closure to determine whether it
is in the public interest, or whether the general public would benefit from the vacation of
the right-of-way.
The following findings have been made:
• A portion of the remaining alley will be paved, a new Baywalk will be provided and a
public park will be developed. A new public access easement from NE 27 Street will
be provided to enhance access to the Baywalk and bayfront.
• The portion of the alley proposed to be closed and vacated is not currently being
used by the general public, service vehicles or for emergency access. Trees are in
the alley that prevenst access. A portion of the alley is submerged.
• A public access easement will be provided to the remaining portion of the alley that
will provide continuous unrestricted access for the Crimson Tower property and the
entire neighborhood.
• The proposed easement improves access and circulation for pedestrians and
vehicles throughout the neighborhood and to the bayfront. Improved access will be
provided for maintenance of the bayfront and inlet.
• The Plat and Street Committee members voted 6 in favor and 0 in denial of this
alley closure request subject to a minimum 20' wide public ingress/egress
easement being provided on the west side of the property between the extension of
the north right of way Tine of NE 27 Street alley and NE 27 Street
Based on these findings, the Planning and Zoning Department recommends
Approval.

The Plat and Street Committee has reviewed the tentative plat of "Crimson Tower Plat" subdivision and
determined that all technical requirements contained in the Miami City Code Subdivision Regulations
have been met and has approved the tentative plat. The Plat and Street Committee has further
considered the vacation and closure of a portion of an alley located between NE 27 Street and NE 28
Street from approximately 700 feet east of Biscayne Boulevard to Biscayne Bay with respect to the
Miami City Code requirements and has voted to recommend 6 in favor and 0 in denial of this vacation
and closure request subject to a minimum 20 foot wide public ingress/egress easement being provided
on the west side of the property between the extension of the north right of way line of said alley and
NE 27 Street.

The City of Miami Plat and Street Committee, at its meeting of September 6, 2012 approved the above
tentative plat subject to the following revisions being made to the tentative plat, additional information
being provided and/or variances being granted. Please be advised that the processing of your tentative plat
cannot proceed until these conditions have been satisfied:
1. On the location sketch:
a) Provide the zoning designation and zoning district lines.
b) Provide the lots and blocks and names of the surrounding subdivisions.
c) In the legal description, correct the page number.
2. Correct the tentative plat name in the application and main sketch.
3. Provide the bearings and distances for the monument lines and centerlines fronting the proposed
plat.
4. Provide a Block corner tie.
5. A portion of the 15' strip of land included in the description is submerged land. Provide proof of
ownership of the submerged portion.
6. This tentative plat is to be coordinated with the Garden Park on the Bay tentative plat and
includes a minimum 20' wide public ingress/egress easement along the west side of the proposed
plat between NE 27 Street Alley and NE 27 Street. If the easement is to be provided by separate
instrument, the identification of the easement and recording information shall be noted for
informational purposes on the final plat.
7. Provide a Certified Corner Record.
8. Additional right of way dedication (7') is required along NE 27 Street.
9. Provide existing elevations on 20'-25' intervals along the centerline, proposed face of sidewalk
and top of seawall.
10. Provide existing underground utility information within the roadway abutting the tentative plat,
including the inverts, pipe diameter and pipe direction of the existing storm sewers.
11. Show the existing curb along NE 27 Street.
12. Provide a tree list in table form including common and botanical names, height, diameter and
spread.

13. Show the zoning designation according to Miami 21. Provide a complete description of the
zoning information.
14. Indicate that the tentative plat is a boundary survey.
15. Provide a copy of the Agreement identified in the instruments affecting the site.
16. Remove the note concerning the alley closure resolution.
17. Identify the alley to be closed and vacated and include the area in square feet.
18. Show the existing pavement in NE 27 Street alley and North Bayshore Drive approximately 25'
west and north. Also, show any existing trees.
19. Existing elevations must be on City of Miami datum.
20. Provide the source of the flood criteria.
21. Identify the owner on the tentative plat.
22. All existing utilities, if any, located in the alley to be closed and vacated must be relocated or
easements must be provided.
23. An opinion of title as to the reversionary rights for the right-of-way to be closed and vacated will
be required by the Planning, Zoning and Appeals Board. The opinion of title must also address
whether or not there are individuals, in addition to the abutting property owners, having an
interest in the right of way to be closed and vacated. A copy of the opinion of title must be
provided to the Public Works Department.
24. The Planning, Zoning and Appeals Board will require a sketch and legal description with a square
footage, on an 8 'A" X 11" paper, for the proposed closure. Contact the Office of Hearing Boards
at 305-416-2030. Provide a copy to the Public Works Department.
25. A letter from Comcast is required to determine if any adjustments to their facilities or easements
are required.
26. Verify with Miami -Dade County that the proposed plat name is acceptable.
27. All encroachments across proposed tract and/or lot lines must be removed prior to final plat
submittal.
28. An opinion of title, in the City of Miami opinion of title fonn, must be provided at the time of
final plat submittal.
29. Current backup documentation will be required for all who execute the final plat. A resolution for
authority to execute documents and a Certificate of Good Standing from the Secretary of State are
required, if applicable.
30. Tentative plat application must be made with Miami -Dade County after receiving approval from
the City of Miami Plat and Street Committee.
31. Be advised that an incomplete final plat package will not be accepted by the City of Miami. It is
the owner's responsibility to work with his surveyor and his attorney to assure that everything is
in order before submitting the final plat package.
32. Be advised that if all of the requirements for scheduling the final plat for City Commission action
are not in order, the final plat will not be scheduled for a City Commission meeting.
33. A letter of concurrency from the Miami -Dade County School Board is required prior to the final
plat approval (see contact sheet).
34. The Plat and Street Committee has reviewed the tentative plat of "Crimson Tower Plat" and

of way line of NE 27 Street Alley and NE 27 Street.
In addition to the above requirements, you should be aware of the following:
1. State and local laws require the installation of various physical improvements in the public
rights -of -way when property is platted. These subdivision improvements include paving,
drainage, landscaping, sidewalks, etc. In some cases this could represent a substantial
investment on your part. REQUIRED: The submission of an electronic copy of the tentative
plat, in an AutoCAD version, to the City of Miami Public Works Development and Roadway
Plans Section will EXPEDITE the preparation and enhance the ACCURACY of the
subdivision improvement estimate letter required for final plat approval.
2. The alteration, relocation or installation of utilities such as storm and sanitary sewers,
electric, telephone, water, etc., caused by this plat will be at the property owner's expense.
Also, utility easements may be required on the property being platted.
3. A building permit will not be issued on the property being platted until the final plat is
recorded or as authorized by City of Miami Code Section 55-10 (h). Also, the Certificate of
Occupancy for any building construction will be issued only after all the required subdivision
improvements have been completed.
4. Approval for fire flow requirements must be obtained from the Fire -Rescue Depattinent prior
to the issuance of a building permit.
5. In order to mitigate problems associated with access and construction activities throughout
the neighborhood, the contractor/developer is encouraged to notify the affected neighborhood
residents, in writing, of the project starting and completion dates at the time of issuance of
permits. The contractor/developer may coordinate the notification of residents with the local
City of Miami NET Service Center.
6. Additional items must be provided to the City of Miami Department of Public Works before
the final plat is submitted to the City Commission for approval. You will be notified in
writing as to what these items are after the amount of the bond has been determined for the
necessary subdivision improvements.
7. Tentative plat approval is only valid for one (1) year and six (6) months from the date of the
Plat and Street Committee meeting at which time it was approved.
If you have any questions concerning these requirements, please refer to the attached sheet for the
appropriate person to contact.

Dear Mr. Rodriguez:
Our firm represents Alpine Estates, LLC (hereinafter, the "Applicant") in the above -
referenced matter. Our client respectfully requests the City of Miami's ("City") approval of the
vacation and closure of a portion of the 15' wide platted alley which abuts a portion of the
above referenced properties. Pursuant to Sec. 55-15 of the Miami Code of Ordinances ("City
Code") the Applicant is requesting the vacation and closure of the affected portion of the alley.
The subject properties are located towards the eastern end of NE 27th Street, on the north
side (the "Property"). The site is bounded by an inlet of Biscayne Bay to the north. Currently,
the site consists of a vacant unimproved lot.
The majority of the portion of the alley that is petitioned to be vacated is unimproved
and, in fact, a portion is submerged. In this location (abutting the Applicant's property), the
alley is, by and large, a "paper alley". Enclosed are all of the required surveys for the portion of
the alley which is the subject of this request and an aerial photograph of the Applicant's

property, marked as "Exhibit 1", depicting the approximate boundary of the area of the alley to
be vacated. Also included as part of said exhibit are two photographs of the alley also depicting
the approximate boundary of the portion to be vacated.
The vacated portion of the alley would be incorporated into the Applicant's platted lots
via a replat of the Applicant's property. A tentative plat application was submitted to the City
of Miami Public Works Department on August 21, 2012, and, as of the date of this letter, is
scheduled to be considered by the Plat & Street Committee at its September 6, 2012 meeting.
Correspondingly, we do not have the letter from the Plat & Street Committee as part of this
application, but we will provide it as soon as it is available.
To the north of the western end of the portion of the alley proposed to be vacated lies the
right of way of North Bayshore Drive. Recently, the developer of the proposed Tower on the
Bay project, the Related Group, received approval from the City for the vacation of North
Bayshore Drive and other surrounding rights of way, including a portion of NE 281" Street. The
Applicant and the Related Group are coordinating their plans for the land in-between the two
projects. The Applicant will utilize the portion of the alley to be vacated to build a connection
from the baywalk located on the Applicant's property to the baywalk and park proposed with
the Tower on the Bay project.
Also, the Applicant is aware that the vacation of the alley, in concert with the vacation of
North Bayshore Drive, creates a dead end alley, which is inconsistent with the standards in the
City's Public Works Manual. Therefore, the Applicant will proffer an easement upon the
westernmost 20' of the Applicant's property, stretching from the alley to NE 27th Street, for the
purposes of public access so that a dead end condition is not created. The Applicant will
dedicate this easement by separate recorded instrument at the time the aforementioned Tower
on the Bay project receives final plat approval and perfects the vacation of North Bayshore
Drive. The recording information of the public access easement will be shown on the final plat
of the Crimson Tower plat.
The public access easement on the westernmost 20' of the Applicant's property will
significantly improve the existing condition. Currently, the eastern terminus of the alley is
unimproved. The western 20' of the Applicant's property will be improved with a driveway,
sidewalk and related landscaping. This will greatly improve the vehicular and pedestrian
circulation within the neighborhood.
Currently the portion of the alley proposed to be vacated is not being used for garage,
fire or police access.

2. Description of area: a 15' wide alley (a.k.a. NE 27'" Terrace), lying generally at the far eastern end of the platted extent of the alley
3. Copies of the Tentative Plat: One (1) 24x36" and one (1) 8%x11" prepared by a State of Florida
registered land surveyor.
4. Original sketch of surveys: a) One (1) 24x36"; b) Two (2) 11x17"; and c) One (1) 8%x11" prepared
by a State of Florida Registered Land Surveyor showing only the area to be vacated or closed and
the pertinent legal description of the area, within one year from the date of application.
5. Opinion of Title addressing the reversionary rights, if any. Note: An update is required if more than
three (3) months elapse before Zoning Board or City Commission approval.
6. Signed Tentative Plat letter from Public Works indicating Plat & Street recommendation.
