The following findings have been made: • A portion of the remaining alley will be paved, a new Baywalk will be provided and a public park will be developed. A new public access easement from NE 27 Street will be provided to enhance access to the Baywalk and bayfront. • The portion of the alley proposed to be closed and vacated is not currently being used by the general public, service vehicles or for emergency access. Trees are in the alley that prevenst access. A portion of the alley is submerged. • A public access easement will be provided to the remaining portion of the alley that will provide continuous unrestricted access for the Crimson Tower property and the entire neighborhood. • The proposed easement improves access and circulation for pedestrians and vehicles throughout the neighborhood and to the bayfront. Current backup documentation will be required for all who execute the final plat. A resolution for authority to execute documents and a Certificate of Good Standing from the Secretary of State are required, if applicable. 30. In addition to the above requirements, you should be aware of the following: 1. State and local laws require the installation of various physical improvements in the public rights -of -way when property is platted. These subdivision improvements include paving, drainage, landscaping, sidewalks, etc. In some cases this could represent a substantial investment on your part. REQUIRED: The submission of an electronic copy of the tentative plat, in an AutoCAD version, to the City of Miami Public Works Development and Roadway Plans Section will EXPEDITE the preparation and enhance the ACCURACY of the subdivision improvement estimate letter required for final plat approval. 2. The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric, telephone, water, etc., caused by this plat will be at the property owner's expense. In order to mitigate problems associated with access and construction activities throughout the neighborhood, the contractor/developer is encouraged to notify the affected neighborhood residents, in writing, of the project starting and completion dates at the time of issuance of permits. The contractor/developer may coordinate the notification of residents with the local City of Miami NET Service Center. 6. Additional items must be provided to the City of Miami Department of Public Works before the final plat is submitted to the City Commission for approval. You will be notified in writing as to what these items are after the amount of the bond has been determined for the necessary subdivision improvements. 7. Crimson Tower Dear Mr. Rodriguez: Our firm represents Alpine Estates, LLC (hereinafter, the "Applicant") in the above - referenced matter. Our client respectfully requests the City of Miami's ("City") approval of the vacation and closure of a portion of the 15' wide platted alley which abuts a portion of the above referenced properties. Pursuant to Sec. 55-15 of the Miami Code of Ordinances ("City Code") the Applicant is requesting the vacation and closure of the affected portion of the alley. The subject properties are located towards the eastern end of NE 27th Street, on the north side (the "Property"). The site is bounded by an inlet of Biscayne Bay to the north. Currently, the site consists of a vacant unimproved lot. The majority of the portion of the alley that is petitioned to be vacated is unimproved and, in fact, a portion is submerged. In this location (abutting the Applicant's property), the alley is, by and large, a "paper alley". The vacated portion of the alley would be incorporated into the Applicant's platted lots via a replat of the Applicant's property. A tentative plat application was submitted to the City of Miami Public Works Department on August 21, 2012, and, as of the date of this letter, is scheduled to be considered by the Plat & Street Committee at its September 6, 2012 meeting. Correspondingly, we do not have the letter from the Plat & Street Committee as part of this application, but we will provide it as soon as it is available. To the north of the western end of the portion of the alley proposed to be vacated lies the right of way of North Bayshore Drive. Recently, the developer of the proposed Tower on the Bay project, the Related Group, received approval from the City for the vacation of North Bayshore Drive and other surrounding rights of way, including a portion of NE 281" Street. The Applicant and the Related Group are coordinating their plans for the land in-between the two projects. The Applicant will utilize the portion of the alley to be vacated to build a connection from the baywalk located on the Applicant's property to the baywalk and park proposed with the Tower on the Bay project. Also, the Applicant is aware that the vacation of the alley, in concert with the vacation of North Bayshore Drive, creates a dead end alley, which is inconsistent with the standards in the City's Public Works Manual. Therefore, the Applicant will proffer an easement upon the westernmost 20' of the Applicant's property, stretching from the alley to NE 27'h Street, for the purposes of public access so that a dead end condition is not created. The Applicant will dedicate this easement by separate recorded instrument at the time the aforementioned Tower on the Bay project receives final plat approval and perfects the vacation of North Bayshore Drive. The recording information of the public access easement will be shown on the final plat of the Crimson Tower plat. The public access easement on the westernmost 20' of the Applicant's property will significantly improve the existing condition. Currently, the eastern terminus of the alley is unimproved. The western 20' of the Applicant's property will be improved with a driveway, sidewalk and related landscaping. This will greatly improve the vehicular and pedestrian circulation within the neighborhood.
