HomeMy WebLinkAboutDepartment Analyses & Color MapsPLANNING DEPARTMENT ANALYSIS Case No. 2011- 00910ac CLOSING, VACATING, ABANDONING AND DISCONTINUING FOR PUBLIC USE AN ALLEY LOCATED BETWEEN NORTHEAST 27th STREET AND NORTHEAST 28tt' STREET FROM APPROXIMATELY 700 FEET EAST OF BISCAYNE BOULEVARD TO BISCAYNE BAY Pursuant to Section 55-15 (c) of the Miami City Code, the Planning Department has reviewed the proposed public right-of-way vacation and closure to determine whether it is in the public interest, or whether the general public would benefit from the vacation of the right-of-way. The following findings have been made: • A portion of the remaining alley will be paved, a new Baywalk will be provided and a public park will be developed. A new public access easement from NE 27 Street will be provided to enhance access to the Baywalk and bayfront. • The portion of the alley proposed to be closed and vacated is not currently being used by the general public, service vehicles or for emergency access. Trees are in the alley that prevenst access. A portion of the alley is submerged. • A public access easement will be provided to the remaining portion of the alley that will provide continuous unrestricted access for the Crimson Tower property and the entire neighborhood. • The proposed easement improves access and circulation for pedestrians and vehicles throughout the neighborhood and to the bayfront. Improved access will be provided for maintenance of the bayfront and inlet. • The Plat and Street Committee members voted 6 in favor and 0 in denial of this alley closure request subject to a minimum 20' wide public ingress/egress easement being provided on the west side of the property between the extension of the north right of way line of NE 27 Street alley and NE 27 Street Based on these findings, the Planning and Zoning Department recommends Approval. NE 27 TERRACE), MIAMI, FLORIDA The Plat and Street Committee has reviewed the tentative plat of "Crimson Tower Plat" subdivision and determined that all technical requirements contained in the Miami City Code Subdivision Regulations have been met and has approved the tentative plat. City Manager The City of Miami Plat and Street Committee, at its meeting of September 6, 2012 approved the above tentative plat subject to the following revisions being made to the tentative plat, additional information being provided and/or variances being granted. Please be advised that the processing of your tentative plat cannot proceed until these conditions have been satisfied: 1. On the location sketch: a) Provide the zoning designation and Xining district lines, b) Provide the lots and blocks and names of the surrounding subdivisions. c) In the legal description, correct the page number. 2. Correct the tentative plat name in the application and main sketch. 3, Provide the bearings and distances for the monument lines and centerlines fronting the proposed plat, 4. Provide a Block corner tie. 5. A portion of the 15' strip of land included in the description is submerged land, Provide proof of ownership of the submerged portion. 6. This tentative plat is to be coordinated with the Garden Park on the Bay tentative plat and includes a minimum 20' wide public ingress/egress easement along the west side of the proposed plat between NE 27 Street Alley and NE 27 Street. If the easement is to be provided by separate instrument, the identification of the easement and recording information shall be noted for informational purposes on the final plat. 7. Provide a Certified Corner Record, 8. Additional right of way dedication (7') is required along NE 27 Street, 9. Provide existing elevations on 20'-25' intervals along the centerline, proposed face of sidewalk and top of seawall. 10. Provide existing underground utility information within the roadway abutting the tentative plat, including the inverts, pipe diameter and pipe direction of the existing storm sewers. 11, Show the existing curb along NE 27 Street. 12. Provide a tree Iist in table form including common and botanical names, height, diameter and spread. Provide a complete description of the zoning information. 14, Indicate that the tntative plat is a boundary survey, 15. Provide a copy of the Agreement identified in the instruments affecting the site. 16. Remove the note concerning the alley closure resolution. 17. Identify the alley to be closed and vacated and include the area in square feet. 18. Show the existing pavement in NE 27 Street alley and North Bayshore Drive approximately 25! west and north. Also, show any existing trees, 19. Existing elevations must be on City of Miami datum. 20, Provide the source of the flood criteria. 21. Identify the owner on the tentative plat. 22. All existing utilities, if any, located in the alley to be closed and vacated must be relocated or easements must be provided. 23. An opinion of title as to the reversionary rights for the right-of-way to be closed and vacated will be required by the Planning, Zoning and Appeals Board. The opinion of title must also address whether or not there are individuals, in addition to the abutting property owners, having an interest in the right of way to be closed and vacated. A copy of the opinion of title must be provided to the Public Works Department. 24, The Planning, Zoning and Appeals Board will require a sketch and legal description with a square footage, on an 8 !/" X 11" paper, for the proposed closure. Contact the Office of Hearing Boards at 305-41 b-2030. Provide a copy to the Public Works Department, 25. A letter from Comcast is required to determine if any adjustments to their facilities or easements are required. 26. Verify with Miami -Dade County that the proposed plat name is acceptable. 27. All encroachments across proposed tract andlor lot lines must be removed prior to final plat submittal. 28. An opinion of title, in the City of Miami opinion of title form, must be provided at the time of final plat submittal. 29, Current backup documentation will be required for all who execute the final plat. A resolution for authority to execute documents and a Certificate of Good Standing from the Secretary of State are required, if applicable. 30. Tentative plat application must be made with Miami -Dade County after receiving approval from the City of Miami Plat and Street Committee. 31. Be advised that an incomplete final plat package will not be accepted by the City of Mianni. It is the owner's responsibility to work with his surveyor and his attorney to assure that everything is in order before submitting the final plat package. 32. Be advised that if all of the requirements for scheduling the final plat for City Commission action. are not in order, the final plat will not be scheduled for a City Commission meeting. 33. A letter of concurrency from the Miami -Dade County School Board is required prior to the final plat approval (see contact sheet). 34. The Plat and Street Committee has reviewed the tentative plat of "Crimson Tower Plat" and determined that all technical requirements contained in the Miami City Code Subdivision Regulations have been net and has approved the tentative plat. The members of the. In addition to the above requirements, you should be aware of the following: 1. State and local laws require the installation of various physical improvements in the public rights -of -way when property is platted. These subdivision improvements include paving, drainage, landscaping, sidewalks, etc. In some cases this could represent a substantial investment on your part. REQUIRED: The submission of an electronic copy of the tentative plat, in an AutoCAD version, to the City of Miami Public Works Development and Roadway Plans Section will EXPEDITE the preparation and enhance the ACCURACY of the subdivision improvement estimate letter required for final plat approval. 2. The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric, telephone, water, etc., caused by this plat will be at the property owner's expense. Also, utility easements may be required on the property being platted. 3. A building permit will not be issued on the property being platted until the final plat is recorded or as authorized by City of Miami Code Section 55-10 (h). Also, the Certificate of Occupancy for any building construction will be issued only after all the required subdivision improvements have been completed, 4. Approval for fire flow requirements must be obtained froth the Fire -Rescue Department prior to the issuance of a building permit 5. In order to mitigate problems associated with access and construction activities throughout the neighborhood, the contractor/developer is encouraged to notify the affected neighborhood residents, iri writing, of the project starting and completion dates at the time of issuance of permits. The contractor/developer may coordinate the notification of residents with the local City of Miami NET Service Center. 6. Additional items must be provided to the City of Miami Department of Public Works before the final plat is submitted to the City Commission for approval. You will be notified in writing as to what these items are after the amount of the bond has been determined for the necessary subdivision improvements. 7. Tentative plat approval is only valid for one (I) year and six (6) months from the date of the Plat and Street Committee meeting at which time it was approved.
