HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-01077 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS (4/5THS), AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92(A)(1) AND (3) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND APPROVING THE PROCUREMENT OF SERVICES FROM AT&T, FORA FULLY MANAGED; HOSTED NG911 SOLUTION, FOR THE DEPARTMENT OF POLICE, FOR AN INITIAL TERM OF FIVE (5) YEARS, WITH THE OPTION TO RENEW FOR ONE (1) ADDITIONAL FIVE (5) YEAR PERIOD, AT A FIRST YEAR COST NOT TO EXCEED $2,577,778.88 AND FOR EACH SUBSEQUENT FISCAL YEAR, AT AN ANNUAL AMOUNT NOT TO EXCEED $577,778.88, PLUS AN ADDITIONAL ANNUAL AMOUNT OF $128,964.96 TO BE PAID DIRECTLY TO THE STATE OF FLORIDA FOR NETWORK ACCESS FEES, PURSUANT TO MYFLORIDANET STATEWIDE PRICES, SUBJECT TO FUTURE RATE ADJUSTMENTS BY THE STATE OF FLORIDA; ALLOCATING FUNDS FROM THE E-911 SPECIAL REVENUE PROJECT NUMBER 19-196003, AWARD 1214, ACCOUNT CODES: 12000.190351.534000.0000.00000 AND 12000.190351. 541000. 0000.00000; FURTHER AUTHORIZING THE CITY MANAGER, AFTER CONSULTATION WITH THE CITY ATTORNEY, TO NEGOTIATE AND EXECUTE A PROFESSIONAL SERVICES AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID SERVICE ACQUISITION. WHEREAS, the Department of Police is seeking for the City of Miami ("City") to enter into an agreement for a fully managed, hosted NG911 solution that would replace the current E911 infrastructure at both the primary E911 site at the Miami Police Central Station and the backup site at the Miami Fire College; and WHEREAS, pursuant to Section 18-92(a) (1) and (3) of the Code of the City of Miami, Florida, as amended (."City Code"), the Chief Procurement Officer has adopted a finding that AT&T, the provider, is the sole source provider of this kind of fully managed, hosted solution for 911 equipment, located in 2 geographically diverse AT&T offices, and co -located to the network connection points that service the City; and WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as the finding of the City Manager; and WHEREAS, Informal Request for Proposal Number 284273 was issued to AT&T so that they may propose various hosted solution options for the City to consider; and WHEREAS, AT&T provided an oral presentation and functional demonstration to the evaluation committee who recommended that the City enter into negotiations with AT&T to provide the fully City of Miami Page 1 of 2 File Id: 12-01077 (Version: 1) Printed On: 10/9/2012 File Number: 12-01077 managed, hosted NG911 solution; and WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirements for competitive sealed bidding procedures be waived and the procurement of the above solution as specified be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. By a four -fifths (4/5ths), affirmative vote, pursuant to Section 18-92(a)(1) and (3) of the City Code, as amended, after an advertised public hearing, the City Manager's finding of a sole source, is ratified, approved and confirmed, the requirements for competitive sealed bidding procedures are waived, and the procurement of services, from AT&T, for a fully managed, hosted NG911 solution, for the Department of Police, for an initial term of five (5) years, with the option to renew for one (1) additional five (5) year period, is approved, at a first year cost not to exceed $2,577,778.88 and for each subsequent fiscal year, at an annual amount not to exceed $577,778.88, plus an additional annual amount of $128,964.96 to be paid directly to the State of Florida for network access fees, pursuant to MyFloridaNet statewide prices, subject to future rate adjustments by the State of Florida, with funds allocated from the Department of Police Account Code Number the E-911 Special Revenue Project Number 19-196003, Award 1214, Account Codes: 12000.190351.534000.0000.00000 and 12000.190351. 541000. 0000.00000. Section 3. The City Manager is authorized{1}, after consultation with the City Attorney, to negotiate and execute a Professional Services Agreement, in substantially the attached form, for said service acquisition. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED .AS.TO FORM AND CORRECTNESS: CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
