City of Miami Legislation Resolution Enactment Number: R-24-0379 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16668 Final Action Date:9/26/2024 A RESOLUTION OF THE MIAMI CITY COMMISSION PURSUANT TO CHAPTER 62/ARTICLE XIII/DIVISION 1/SECTION 62-521(B)(3) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TITLED "PLANNING AND ZONING/PLANNING AND ZONING APPROVAL FOR TEMPORARY USES AND OCCUPANCIES; PERMIT REQUIRED/TEMPORARY EVENT PERMITS/TEMPORARY EVENTS IN GENERAL," WAIVING THE TIME LIMITATION OF TEN (10) TEMPORARY EVENTS FOR A MAXIMUM OF TWO (2) WEEKS EACH PER YEAR ON PUBLIC PROPERTY FOR SPECIAL EVENTS THAT ARE HELD AT 3385 PAN AMERICAN DRIVE, MIAMI, FLORIDA, FROM OCTOBER 1, 2024 THROUGH DECEMBER 31, 2024, WITH CONDITIONS AS STATED HEREIN. WHEREAS, the property located at 3385 Pan American Drive, Miami, Florida ("Property") is owned by the City of Miami, Florida ("City") and has held its maximum of ten (10) temporary events this year; and WHEREAS, a public property is allowed ten (10) temporary events, two (2) week each for a calendar year pursuant to Section 62-521(b)(3) Code of the City of Miami, Florida, as amended ("City Code"); and WHEREAS; the Property requires a waiver of the Temporary Event Permit ("TEP") limitation as provided for in Section 62-521(b)(4) of the City Code, wherein the number and time limitations for temporary events may be waived upon affirmative vote of the City Commission; and WHEREAS, from October 1, 2024, through the end of the year, the Property will be host to charitable and other such special events involving Amigos for Kids, the Pinta Art Basel Week event and the Sony Latin Grammy's event; and WHEREAS, some of the events have a standing history of being held at the Property; and WHEREAS, these events spotlight our community, attract visitors and locals alike and promote the City in a positive light; and WHEREAS, notwithstanding the issuance of this waiver pursuant to Section 62-521(b) of the City Code, any events must comply with all other City Code requirements and applicable Florida law; and WHEREAS, none of the TEP's shall take place or use the grounds of Regatta Park; and WHEREAS, three (3) or more City Code violations issued at the Property will result in an automatic rescission of this approval and this waiver shall be deemed void; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Temporary Event Permit limitation of ten (10) events per year per public property is waived for the property located at 3385 Pan American Drive, Miami, Florida, to host various events from October 1, 2024, through December 31, 2024. All TEP event applicants are required to obtain permits as necessary and pay all fees for each applicable Temporary Event. Section 3. Three (3) or more violations of the City Code will result in an automatic rescission of this waiver. Section 4. No TEP pursuant to this waiver shall use the grounds of Regatta Park. Section 5. This Resolution shall become effective immediately upon its adoption. APPROVED AS TO FORM AND CORRECTNESS: rge�.
