A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING THE BID RECEIVED SEPTEMBER 28, 2012, PURSUANT TO
INVITATION FOR BIDS NO. 11-12-052, FROM SFM SERVICES, INC. THE
LOWEST RESPONSIVE AND RESPONSIBLE BIDDER, FOR THE PROJECT
ENTITLED "US-1 LANDSCAPE MAINTENANCE CONTRACT, M-0087" FOR A ONE
(1) YEAR PERIOD, IN AN ANNUAL AMOUNT NOT TO EXCEED $93,220, WITH
FOUR (4) ADDITIONAL ONE (1) YEAR OPTIONS TO RENEW; ALLOCATING SAID
FUNDS, FROM ACCOUNT NUMBERS 00001.204000.534000.0.0 AND
00001.207000.534000.0.0; AUTHORIZING THE CITY MANAGER TO EXECUTE A
CONTRACT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID PROJECT;
FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE SAID OPTIONS
TO RENEW SUBJECT TO THE AVAILABILITY OF FUNDING AND THE
CONTRACTOR'S PERFORMANCE.
WHEREAS, on September 28, 2012, the Office of the City Clerk received formal bid
#11-12-052 for the project entitled "US-1 Landscape Maintenance Contract, M-0052;" and
WHEREAS, SFM Services, Inc. submitted the lowest responsive and responsible bid in the
amount of $102,778; and
WHEREAS, Florida Lawn Services, Inc., a bidder with a local office as defined in Section 18-73
of the Code of the City of Miami ("City Code"), as amended, submitted a bid in the amount of
$109,930; and
WHEREAS, in accordance with Section 18-89 of the City Code, when a responsive,
responsible non -local bidder submits the lowest bid price, and the bid submitted by one or more
responsive, responsible local bidders who maintain a local office is within fifteen percent (15%) of the
price submitted by the non -local bidder, then that non -local bidder and each of the aforementioned
responsive, responsible local bidder(s) shall have the opportunity to submit a best and final bid equal
to or lower than the amount of the low bid previously submitted by the non -local bidder; and
WHEREAS, SFM Services, Inc. submitted the lowest best and final bid in the annual amount of
$93,220;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. The bid received September 28, 2012, pursuant to Invitation for Bids No. 11-12-052,
from SFM Services, Inc., for the project entitled "US-1 Landscape Maintenance Contract, M-0087," for

a one (1) year period, in an annual amount not to exceed $93,220, with four (4) additional one (1) year
options to renew, in an annual amount not to exceed $93,220.00, is accepted, with•funds allocated
from Account Numbers 00001.204000.534000.0.0 and 00001.207000.534000.0.0.
Section 3. The City Manager is authorized {1} to execute a Contract, in substantially the attached
form, for said project.
Section 4. The City Manager is further authorized {1} to execute said options to renew subject to
the availability of funding and the contractor's performance.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
