HomeMy WebLinkAboutMemo - Infusion SystemCITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO: FROM : Kenneth Robertson Chief Procurement Officer/Purchasing Director Yusbel Gonzalez, CPPB Sr Procurement Sp; ialist DATE : SUBJECT: REFERENCES: ENCLOSURES: November 26, 2012 FILE : EZ-IO Intraosseous Infusion System and Accessories Sole Source# 12-13-007 investigation was conducted to determine whether Vidacare Corp., a Non -Local vendor, located at 4350 Lockhill Selma Road, Suite 150, Shavano Park, TX 78249 is still the sole -source provider of the EZ-IO Intraosseous Infusion System and Accessories, for the Department of Fire -Rescue. Fire Departments across the nation utilize the EZ-IO Intraosseous Infusion System as the leading choice for intraosseous access across multiple health care settings, and it is used by 90 percent of United States (US) advanced life support ambulances over half of US Emergency Departments. EZ-IO can be used to quickly establish stable and secure vascular access in less than 10 seconds for adults and children, awake or unconscious. Many EMS services in the US are using EZ-IO as their first line solution for vascular access in cardiac arrest and resuscitation scenarios, enabling critical medications and fluids to be given very early in resuscitative efforts. Recent research suggests early interventions in resuscitation can substantially improve patient outcomes. Although in the market there exists other Intraosseous Infusion Systems (Cook Med, WaisMed Ltd., and Pyng Medical), only Vidacare Corp., offers a "power driver" to easily establish intraosseous access as opposed to it being established manually. The use of the power driver provides a higher success rate of establishing infusions as opposed to the manual infusion method provided by others. PURCHASE HISTORY Effective October 26, 2009, via an informal bid process, the EZ-IO 15 mm, 25 mm, and 45 mm sterile needle sets were added and made a part of the City's Bid Contract IFB 34019 for the provision of Medical Supplies. The awarded bidder for these products was Sovereign Medical LLC. Effective November 1, 2011, Vidacare Corp., the manufacturer of the EZ-IO Intraosseous Infusion System and Accessories, discontinued the distribution of these products through authorized reseliers and began to sell them directly (see Attachment 1). That change was done in different phases, with Florida being one of the States in Vidacare's last phase of switching its distribution channel. As a result of the above mentioned change, on October 31, 2011, the Chief Procurement Officer approved a sole -source finding and made a determination to award a sole -source contract to Vidacare, Corp., not exceeding $25,000 with a one (1) year term (November 1, 2011 through October 31, 2012), in accordance with Section 18-92 of the City Code. To date, the $25,000 contract spend limit has been reached. 1 RECOMMENDED ACTION Given that the Department of Fire -Rescue still needs to continue procuring the EZ-IO Intraosseous Infusion System and Accessories, and given that a recent investigation has determined that Vidcare Corp., is still the only provider of this equipment, issuing a competitive solicitation for this procurement wouldn't be practical for the City. In accordance with Section 18-92(a)(1) of the City of Miami Procurement Ordinance, "sole -source awards may be made [...] Where the compatibility of equipment, accessories, or replacement parts permits one reasonable source of supply." Accordingly, pursuant to Section 18-92 of the City of Miami Procurement Ordinance, I am recommending that the requirements for competitive bidding be waived, and these findings be approved: Vidacare Corp., a Non -Local vendor, located at 4350 Lockhill Selma Road, Suite 150, Shavano Park, TX 78249. is the sole -source provider of the EZ-IO lntraosseous Infusion System and Accessories for the Department of Fire -Rescue. The terms and conditions of the sole -source contract have been negotiated so as to obtain the most favorable terms and conditions, including price, as may be offer to other customers or clients by Vidacare, Corp. The sole -source contract will be for a term of one (1) year, with the option to renew for two (2) additional one (1) year periods. Prices will remain fixed and firm for the first year of the contract. Price increases/decreases will be mutually approved by both Vidacare and the City. Funds for this procurement will be allocated from the Department of Fire -Rescue general fund account no. 00001.184010.552100.0000.00000.
