Directo Chief %" v�'r%vt�✓ City Manager Page 1 of 2 Subject Revocable License Agreement with CHLN, Inc. for the occupancy of City of Miami -owned property located at 51 Chart House Drive, Miami, Florida Background Information; The City of Miami ("City") owns certain property and improvements located at 51 Chart House Drive, Miami, Florida ("Property"). On May 10, 2012, the City Commission ("Commission") adopted Resolution 12-0195 authorizing the City Manager to execute a Revocable License Agreement with CHLN, Inc. ("Licensee") for the temporary use of the Property while the City issued a competitive solicitation process to select an operator who would use and occupy the Property on a long-term basis. The City undertook said _competitive solicitation process. No one was selected. The Revocable License Agreement will terminate on December 31, 2012. As such, the City and the Licensee desire to enter into a new Revocable License Agreement ("Agreement") to continue uninterrupted revenue to the City and uninterrupted service to the patronsof the.waterfront restaurant. Under the terms of the Agreement the Licensee shall pay to the City the greater of a minimum monthly use fee of Four Thousand Dollars ($4,000.00), plus State of Florida Use Tax, if applicable, or three and one-half percent of monthly gross sales, with additional terms and conditions as more particularly set forth in said Agreement.
