FIGURE 1: SUBJECT PROPERTY AERIAL MAP FIGURE 2: 5900 ASSEMBLAGE AERIAL MAP The 5900 Assemblage occupies several platted lots with frontages on NE 2 Avenue and NE 59 Street, within the boundaries of the Little Haiti Revitalization Trust, an area identified in need of economic development and neighborhood revitalization. Further, the properties located at 185 NE 59 Street and 5900 NE 2 Avenue are also within the Downtown Little Haiti Cultural District. The property located at 185 NE 59 Street is improved with a two-story mixed -use building constructed in 1959. On the ground floor is the Laundromat Art Space, an art gallery and collective working space for local artists. On the second floor are several multifamily residential dwelling units. The property located at 175 NE 59 Street is currently vacant and unimproved. The property located at 5900 NE 2 Avenue is improved with a surface parking lot. Interestingly, that property has a zoning classification of T5-O, which permits a wide -range of residential and commercial uses by -right; whereas the property with the two-story mixed -use building — 185 NE 59 Street, has a zoning classification of T5-R, which does not permit commercial uses as set forth in Article 4, Tables 3 of Miami 21. Section 7.1.2.8.a of Miami 21 requires, in relevant part, that zoning changes occur successionally to a lesser Transect Zone, within the same Transect Zone to a greater or lesser intensity, or to the next higher Transect Zone. The Applicant's proposed rezoning complies with the successional zoning requirement set forth in Section 7.1.2.8.a of Miami 21, as the change from T5-R to T5-O is consistent with a change in intensity within the same Transect Zone; specifically, from R — Restricted to 0 — Open. Section 7.1.2.8.c.1 of Miami 21 provides that a rezoning of property will only be considered where the application involves the extension of an existing Transect boundary unless the rezoning involves at least forty thousand (40,000) square feet of land area or two hundred (200) feet of street frontage on one (1) street. The Applicant's proposed rezoning complies with the transect boundary extension requirement set forth in Section 7.1.2.8.c.1, as the change from T5-R to T5-0 involves an extension of the existing abutting T5-0 Transect boundary to the north, south, and east. COMPLIANCE WITH REZONING CRITERIA SET FORTH IN SECTION 7.1.2.8.F OF MIAMI 21. Section 7.1.2.8.f of Miami 21 requires that the Planning, Zoning and Appeals Board consider an application for rezoning based on the following criteria: 1. The relationship of the proposed amendment to the goals, objectives and policies of the MCNP, with appropriate consideration as to whether the proposed change will further the goals, objectives and policies of the MCNP; the Miami 21 Code; and other city regulations. 2. The need and justification for the proposed change, including changed or changing conditions that make the passage of the proposed change necessary. 3. The zoning change may only be made to the next intensity Transect Zone or by a Special Area Plan, and in a manner which maintains the goals of this Miami 21 Code to preserve Neighborhoods and to provide transitions in intensity and Building Height. ANALYSIS WITH CRITERION #1 — FURTHER THE GOALS, OBJECTIVES, AND POLICIES OF MCNP. The proposed rezoning and FLUM change will further the goals, objectives, and policies of the MCNP and Miami 21 as follows: NOTICE PZ-23-16880 3/26/24 Goal L U- L Maintain a land use pattern that (1) protects and enhances the quality of life in the City's neighborhoods; (2) fosters redevelopment and revitalization of blighted or declining areas; (3) promotes and facilitates economic development and the growth ofjob opportunities in the city; ... (5) promotes the efficient use of land and minimizes land use conflicts while protecting and preserving residential sections within neighborhoods; ... and (7) protects the integrity and quality of the City's existing neighborhoods by insuring public notice, input and appellant rights regarding changes in existing zoning and land use regulations The NE 2 Avenue corridor serves as the anchor for the Downtown Little Haiti Cultural District (the "District") between NE 53 Street an NE 64 Street. The District is comprised of a unique blend of retail, office and residential uses, emphasizing the heritage of the Haitian and Caribbean island culture. However, it is also one of the City's most distressed economic neighborhoods in need of revitalization efforts and redevelopment. Page 5 of 8 320 Miracle Mile, Suite 203. Coral Gables, Florida 33134 T 786 232 0900 wernickco.com wernick&co PLACEMAKING I LAW In the last fifty (50) years only five (5) new buildings have been built within the District, with one (1) of the five (5) being constructed in 1974. Others include the City's Little Haiti Cultural Center completed in 2008, and a self -storage facility, located at 5609 NE 2 Avenue, completed in 2017. The storage facility is the only building to be constructed within the District since the adoption of Miami 21 in October 2009. The property located at 185 NE 59 Street has been held under common ownership with the property located at 5900 NE 2 Avenue, which fronts NE 2 Avenue, since at least 1994. However, the current zoning classification and future land use designation of the property located at 185 NE 59 Street, and the remainder of Subject Property, have prevented any beneficial commercial activation of the 5900 Assemblage because they prohibit all commercial uses, ancillary parking, and other services that would otherwise support the commercial uses permitted on the remainder of the 5500 Assemblage. The property located at 5900 NE 2 Avenue is instead improved with a surface parking lot, despite sitting at key intersection along NE 2 Avenue, across the street from the Little Haiti Cultural Center and Caribbean Marketplace. The proposed rezoning and accompanying FLUM change will consolidate the 5900 Assemblage into a single zoning classification and future land use designation that is consistent with the character of the District and NE 2 Avenue. It's also consistent in its surrounding context as the Subject Property is bound to the north, south, and east by properties with a T5-O zoning classification. This will allow for the activation of the Subject Property for neighborhood -serving commercial uses compatible with the surrounding area, enhancing the quality of life for residents in the surrounding neighborhood (with no change in density or intensity). PolicyLU-1.1.7. Land development regulations and policies will allow for the development and redevelopment of well -designed mixed -use neighborhoods that provide for the full range of residential, office, live/work spaces, neighborhood retail, and community facilities in a walkable area and that are amenable to a variety of transportation modes, including pedestrianism, bicycles, automobiles, and mass transit. Objective LU-1.3. The City will continue to encourage commercial, office and industrial development within existing commercial, office and industrial areas; increase the utilization and enhance the physical character and appearance of existing buildings; encourage the development of well -designed, mixed -use neighborhoods that provide for a variety of uses within a walkable area in accordance with neighborhood design and development standards adopted as a result of the amendments to the City's land development regulations and other initiatives; and concentrate new commercial and industrial activity in areas where the capacity of existing public facilities can meet or exceed the minimum standards for Level of Service (LOS) adopted in the Capital Improvement Element (CIE). As stated above, the current zoning classification and future land use designation of the Subject Property has prevented any beneficial commercial activation of the 5900 Assemblage. Consolidating the 5900 Assemblage into a single zoning classification and future land use designation will allow for transit -oriented, pedestrian -friendly, mixed -use development and a wide Page 6 of 8 320 Miracle Mile, Suite 203. Further, the 5900 Assemblage directly abuts NE 2 Avenue, an identified Transit Corridor within the City, which is intended to service one or more mass transit systems and routes. The Subject Property is in close proximity to multiple trolley stops, specifically, the Little Haiti Trolly Route, Stops No. 47 and 48. The Subject Project is also served by several Miami -Dade County bus routes, including routes No. 9 and 10. The Subject Property is also in close proximity to Florida East Coast Railway Corridor, which is anticipated to provide a commuter stop to the Little Haiti neighborhood in the near future, as part of the Northeast Corridor of the SMART Program. Policy LU-Z3. Z5. The City will continue to encourage a development pattern that enhances existing neighborhoods by developing a ,balanced mix of uses including areas for employment, shopping, housing, and recreation in close proximityto each other. Policy HO-2. Z3. The City will continue to assure that necessary support services, institutions and amenities are available to existing neighborhoods. The current zoning classification and future land use designation of the Subject Property discourages many of the uses and development patterns that would be desirable and needed for a neighborhood, and also encourages inconsistent land use and conditions that could be harmful to neighborhood residents and other stakeholders. This is seen by the historical use of the 5900 Assemblage which has either remained vacant and unimproved or for uses that don't achieve the highest and best use for the neighborhood, such as a surface parking lot. As stated previously, the proposed rezoning and accompanying FLUM change will consolidate the 5900 Assemblage into a single zoning classification and future land use designation that is consistent with the character of the District and NE 2 Avenue. It's also consistent in its surrounding context as the Subject Property is bound to the north, south, and east by properties with a T5-O zoning classification. This will allow for the activation of the Subject Property for neighborhood -serving commercial uses compatible with the surrounding area, enhancing the quality of life for residents in the surrounding neighborhood. Objective TR-Z 1. Encourage sustainable growth and development that aims to improve mobility, reduce congestion, and supports the overall growth strategy of the City. Consolidating the 5900 Assemblage into a single zoning classification and future land use designation will allow for transit -oriented, pedestrian -friendly, mixed -use development thereby improving mobility and reducing congestion, particular as it pertains to NE 2 Avenue, which the City has identified as a Transit Corridor. ANALYSIS WITH CRITERION #2 —JUSTIFICATION FOR THE PROPOSED CHANGE. The proposed rezoning and accompanying FLUM change will consolidate the 5900 Assemblage into a single zoning classification and future land use designation that is consistent with the character of the District and NE 2 Avenue. It's also consistent in its surrounding context as the Subject Property is bound to the north, south, and east by properties with a T5-O zoning classification. This will allow for a more robust variety of community -serving uses including residential, live/work, art galleries, and other neighborhood serving commercial uses such as restaurants and retail space that is sorely lacking on NE Page 7 of 8 320 Miracle Mile, Suite 203. To the east of the Subject Property is the surface parking lot accessory to the Laundromat Art Space building, within the Applicant's assemblage, which has a T5-O zoning classification and accompanying FLUM designation of Restricted Commercial. To the north of the Subject Property, and extending approximately 175 feet to the west, is a large vacant commercial parcel which has a T5-O zoning classification and accompanying FLUM designation of Restricted Commercial. To the west of the Subject Property is an existing one-story residential rental building that has a zoning classification of T5-R and accompanying FLUM designation of Medium Density Multifamily Residential. To the South of the Subject Property, across NE 59 Street, is a large surface parking lot serving the /nterdenominationa/Haitian Church with a split zoning classification of T5-O/T5-R and a split FLUM desig nation of Restricted Commercia/ a nd Medium Density Multifamily Residential 1. FURTHERANCE OF THE GOALS, OBJECTIVES, AND POLICIES OF THE MCNP The proposed rezoning and FLUM change will further the goals, objectives, and policies of the MCNP as follows: Goa/LU-1. Maintain a land use pattern that (1) protects and enhances the quality of life in the Citys neighborhoods; (2) fosters redevelopment and revitalization of blighted or declining areas; (3) promotes and facilitates economic development and the growth ofjob opportunities in the city; ... (5) promotes the efficient use of land and minimizes land use conflicts while protecting and preserving residential sections within neighborhoods; ... and (7) protects the integrity and quality of the City's existing neighborhoods by insuring public notice, input and appellant rights regarding changes in existing zoning and land use regulations The NE 2 Avenue corridor serves as the anchor for the Downtown Little Haiti Cultural District (the "District") between NE 53 Street an NE 64 Street. The District is comprised of a unique blend of retail, office and residential uses, emphasizing the heritage of the Haitian and Caribbean island culture. However, it is also one of the City's most distressed economic neighborhoods in need of revitalization efforts and redevelopment. In the last fifty (50) years only five (5) new buildings have been built within the District, with one (1) of the five (5) being constructed in 1974. Others include the City's Little Haiti Cultural Center completed in 2008, and a self -storage facility, located at 5609 NE 2 Avenue, completed in 2017. The storage facility is the only building to be constructed within the District since the adoption of Miami 21 in October 2009. The property located at 185 NE 59 Street has been held under common ownership with the property located at 5900 NE 2 Avenue, which fronts NE 2 Avenue, since at least 1994. However, the NOTICE PZ-23-16880 03/26/2 current zoning classification and future land use designation of the property located at 185 NE 59 Street, and the remainder of Subject Property, have prevented any beneficial commercial activation of the 5900 Assemblage because they prohibit all commercial uses, ancillary parking, and other services that would otherwise support the commercial uses permitted on the remainder of the 5500 Assemblage. The property located at 5900 NE 2 Avenue is instead improved with a surface parking lot, despite sitting at key intersection along NE 2 Avenue, across the street from the Little Haiti Cultural Center and Caribbean Marketplace. The proposed rezoning and accompanying FLUM change will consolidate the 5900 Assemblage into a single zoning classification and future land use designation that is consistent with the character of the District and NE 2 Avenue. It's also consistent in its surrounding context as the Subject Property is bound to the north, south, and east by properties with a T5-O zoning classification. This will allow for the activation of the Subject Property for neighborhood -serving commercial uses compatible with the surrounding area, enhancing the quality of life for residents in the surrounding neighborhood. Po/icy LU-Z Z7. Land development regulations and policies wit/ allow for the development and redevelopment of well -designed mixed -use neighborhoods that provide for the full range of residential, office, live/work spaces, neighborhood retail, and community facilities in a walkable area and that are amenable to a variety of transportation modes, including pedestrianism, bicycles, automobiles, and mass transit. Objective LU-Z3. The City will continue to encourage commercial, office and industrial development within existing commercial, office and industrial areas; increase the utilization and enhance the physical character and appearance of existing buildings; encourage the development of well -designed, mixed -use neighborhoods that provide for a variety of uses within a walkable area in accordance with neighborhood design and development standards adopted as a result of the amendments to the City's land development regulations and other initiatives; and concentrate new commercial and industrial activity in areas where the capacity of existing public facilities can meet or exceed the minimum standards for Level of Service (LOS) adopted in the Capital Improvement Element (CIE). As stated above, the current zoning classification and future land use designation of the Subject Property has prevented any beneficial commercial activation of the 5900 Assemblage. Consolidating the 5900 Assemblage into a single zoning classification and future land use designation will allow for transit -oriented, pedestrian -friendly, mixed -use development and a wide variety of uses including residential, office, live/workspaces, neighborhood retail, and community facilities. Further, the 5900 Assemblage directly abuts NE 2 Avenue, an identified Transit Corridor within the City, which is intended to service one or more mass transit systems and routes. The Subject Property is in close proximity to multiple trolley stops, specifically, the Little Haiti Trolly Route, Stops No. 47 and 48. The Subject Project is also served by several Miami -Dade County bus routes, including routes No. 9 and 10. The Subject Property is also in close proximity to Florida East Coast Railway Corridor, which is anticipated to provide a commuter stop to the Little Haiti neighborhood in the near future, as part of the Northeast Corridor of the SMART Program. Po/icy LU-13.15. The City will continue to encourage a development pattern that enhances existing neighborhoods by developing a balanced mix of uses including areas for employment, shopping, housing, and recreation in dose proximity to each other. This is seen by the historical use of the 5900 Assemblage which has either remained vacant and unimproved or for uses that don't achieve the highest and best use for the neighborhood, such as a surface parking lot. As stated previously, the proposed rezoning and accompanying FLUM change will consolidate the 5900 Assemblage into a single zoning classification and future land use designation that is consistent with the character of the District and NE 2 Avenue. It's also consistent in its surrounding context as the Subject Property is bound to the north, south, and east by properties with a T5-O zoning classification. This will allow for the activation of the Subject Property for neighborhood -serving commercial uses compatible with the surrounding area, enhancing the quality of life for residents in the surrounding neighborhood. Objective TR-Z 1 Encourage sustainable growth and development that aims to improve mobility, reduce congestion, and supports the overall growth strategy of the City.
