City of Miami Legislation Resolution Enactment Number: R-24-0381 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16678 Final Action Date:9/26/2024 A RESOLUTION OF THE MIAMI CITY COMMISSION PURSUANT TO CHAPTER 62/ARTICLE XIII/DIVISION 1/SECTION 62-521(B)(3) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TITLED "PLANNING AND ZONING/PLANNING AND ZONING APPROVAL FOR TEMPORARY USES AND OCCUPANCIES; PERMIT REQUIRED/TEMPORARY EVENT PERMITS/TEMPORARY EVENTS IN GENERAL," WAIVING THE TIME LIMITATION OF TEN (10) TEMPORARY EVENTS FOR A MAXIMUM OF TWO (2) WEEKS EACH PER YEAR ON PUBLIC PROPERTY FOR 2024 CARNIVAL EVENTS TO BE HELD AT THE 9TH STREET MALL IN HISTORIC OVERTOWN FROM OCTOBER 10 THROUGH OCTOBER 14, 2024, WITH CONDITIONS AS STATED HEREIN. WHEREAS, the property is a pedestrian walkway in the area of 819 Northwest 2 Avenue and 831 Northwest 2 Avenue known as the 9th Street Mall in the Historic Overtown neighborhood ("Property") and is a public right of way; and WHEREAS, a public property is allowed ten (10) temporary events, two (2) week each for a calendar year pursuant to Section 62-521(b)(3) of the Code of the City of Miami, Florida, as amended ("City Code"); and WHEREAS; the Property requires a waiver of the Temporary Event Permit ("TEP") limitation as provided for in Section 62-521(b)(4) of the City Code, wherein the number and time limitations for temporary events may be waived upon affirmative vote of the City Commission; and WHEREAS, the Property has already held the maximum number events per the City Code; and WHEREAS, 2024 Carnival will be held from October 10 through October 14, 2024 at the 9th Street Mall site in the Historic Overtown neighborhood; and WHEREAS, the Event will have DJ's, live music and performances as well as food truck and beverage service; and WHEREAS, this Event will provide a community gathering place to celebrate Carnival and enjoy our local DJ's, musicians, performers and food vendors; and WHEREAS, notwithstanding the issuance of this waiver pursuant to Section 62-521(b) of the City Code, any events must comply with all other City Code requirements and applicable Florida law; and WHEREAS, three (3) or more City Code violations issued at the Property will result in an automatic rescission of this approval and this waiver shall be deemed void; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Temporary Event Permit limitation to ten (10) events per year per public property is waived for the property known as the 9th Street Mall located in the Historic Overtown neighborhood of Miami, Florida, to host 2024 Carnival from October 10 through October 14, 2024. All TEP event applicants are required to obtain permits as necessary and pay all fees for each applicable Temporary Event. Section 3. Three (3) or more violations of the City Code will result in an automatic rescission of this waiver. Section 4.
