HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-01148 Final Action Date: A RESOLUTION OF THE CITY OF MIAMI COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A NEW LEASE AGREEMENT ("LEASE AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND GOLDEN SANDS ALLAPATTAH CORPORATION, INC., FOR THE USE OF APPROXIMATELY 9,000 SQUARE FEET OF OFFICE SPACE LOCATED AT.1313 NORTHWEST 36TH STREET, MIAMI, FLORIDA, FOR THE PURPOSE OF PROVIDING OFFICE SPACE TO THE INTERNAL AFFAIRS DIVISION OF THE CITY OF MIAMI POLICE DEPARTMENT, WITH A MONTHLY RENT OF $10,875 ($14.50 PER SQUARE FOOT), FOR THE PERIOD OF ONE (1),YEAR WITH THE OPTION TO RENEW FOR FIVE (5) ONE-YEAR TERMS; ALLOCATING FUNDS FROM THE CITY OF MIAMI POLICE DEPARTMENT'S BUDGET, WITH TERMS AND CONDITIONS AS MORE SPECIFICALLY SET FORTH IN SAID LEASE AGREEMENT. WHEREAS, pursuant to Resolution No. 10-0053, adopted February 11, 2010, the City Commission authorized the City Manager to enter into a lease agreement with Golden SandsAllapattah Corporation ("Lessor"), for the, use of 9,000 square feet of office space at 1313 Northwest 36th Street, Miami, Florida ("Property"); and WHEREAS, the City of Miami Police Department's Internal Affairs Division has a continued need to use the office space; and WHEREAS, said lease agreement's term has not yet expired, but the City of Miami ("Lessee") and the Lessor are nonetheless exercising their termination rights for the purpose of entering into the attached new Lease Agreement ("Lease Agreement"); and WHEREAS, the Lessee and the Lessor have negotiated a reduced rental rate for the use and occupancy of the continued use of the office space; and WHEREAS, the Lessee and the Lessor wish to enter into the Lease Agreement for a term of one (1) year, with the option to renew for five (5) successive terms of one (1) year each; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1 } to execute a new Lease Agreement, in substantially the attached form, between Lessee and the Lessor, for the use of approximately 9,000 square feet of office space located at the Property, for the purpose of providing office space to the Internal Affairs Division of the City of Miami Police Department, with a monthly rent of $10,875 ($14.50 per square City of Miami Page 1 of 2 File Id: 12-01148 (Version: 1) Printed On: 10/29/2012 File Number: 12-01148 foot), for the period of one (1) year, with the option to renew for five (5) one-year terms, with funds allocated from the City of Miami Police Department's budget, with terms and conditions as more specifically set forth in said Lease Agreement. BR CITY ATTORNEY\� ,v Footnotes: {1 } The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
