HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-01199 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXTEND THE AGREEMENT END TERM DATE, BETWEEN THE CITY OF MIAMI ("CITY") AND NEIGHBORS AND NEIGHBORS ASSOCIATION, INC., FROM OCTOBER 15, 2012 TO OCTOBER 15, 2013, TO ALLOW FOR THE COMPLETION OF THE REHABILITATION AND CONSTRUCTION IMPROVEMENTS OF THE PROPERTIES LOCATED AT 5861 NORTHWEST 17TH AVENUE AND 5841-45 NORTHWEST 17TH AVENUE, MIAMI, FLORIDA, KNOWN AS THE DISTRICT 5 BUSINESS CORRIDOR EXPANSION PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE EXISTING AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 08-0122, adopted March 13, 2008, the City Commission authorized the allocation of $250,000 in Community Development Block Grant funds to Neighbors and Neighbors Association, Inc. ("NANA") to provide special economic development activities for the rehabilitation and construction improvements of the properties located at 5861 Northwest 17th Avenue and 5841-45 Northwest 17th Avenue, Miami, Florida, known as the District 5 Business Corridor Expansion Project; and WHEREAS, pursuant to Resolution Nos. 10-0362 and 11-0401, adopted September 16, 2010 and October 13, 2011, respectively, the City Commission approved an extension to the Agreement end term date, between the City of Miami ("City") and NANA, from October 15, 2010 to October 15, 2011 and from October 15, 2011 to October 15, 2012, to. allow for the completion of the rehabilitation and construction improvements of the properties located at 5861 Northwest 17th Avenue and 5841-45 Northwest 17th Avenue, Miami, Florida, known as the District 5 Business Corridor Expansion Project; and WHEREAS, on September 15, 2012, the City Department of Community Development received a letter from NANA requesting the contract be extended due to major architectural changes that had to be made to the current plans because of conditions at the property located at 5841-45 Northwest 17th Avenue, Miami, Florida; and WHEREAS, the rehabilitation and construction improvements have been completed at the property located at 5861 Northwest 17th Avenue, Miami, Florida; and WHEREAS, the City Administration recommends the extension of the Agreement end term date, between the City and NANA, from October 15, 2012 to October 15, 2013, to allow for the completion of the rehabilitation and construction improvements of the properties located at 5861 Northwest 17th Avenue and 5841-45 Northwest 17th Avenue, Miami, Florida, known as the District 5 Business Corridor Expansion Project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, City of Miami Page 1 of 2 File Id: 12-01199 (Version: 1) Printed On: 10/24/2012 File Number. 12-01199 FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized{1} to extend the Agreement end term date, between the City and NANA, from October•15, 2012 to October 15, 2013, to allow for the completion of the rehabilitation and construction improvements of the properties located at 5861 Northwest 17th Avenue and 5841-45 Northwest 17th Avenue, Miami, Florida, known as the District 5 Business Corridor Expansion Project. Section 3. The City Manager is authorized{1} to execute an Amendment to the existing Agreement, in substantially the attached form, for said purpose. .Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNES JULIE O. BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City • Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
