HomeMy WebLinkAboutR-12-0436City of Miami Legislation Resolution: R-12-0436 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-01206 Final Action Date: 11/15/2012 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT FUNDS, IN THE AMOUNT NOT TO EXCEED $46,000, CONSISTING OF A GRANT AWARD FROM THE FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION/FLORIDA BOATING IMPROVEMENT PROGRAM ("FBIP"), FOR THE PURPOSE OF REMOVING APPROXIMATELY TWENTY-FOUR (24) IDENTIFIED DERELICT AND ABANDONED VESSELS IN PUBLICLY OWNED CITY OF MIAMI WATERWAYS; AUTHORIZING THE ALLOCATION OF THE CITY'S MATCHING FUNDS, IN THE AMOUNT OF $20,000, FROM CAPITAL IMPROVEMENT PROJECT 40-B30706, AND IN -KIND SERVICES IN THE AMOUNT OF $9,600; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A FBIP GRANT AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, AND ANY OTHER NECESSARY DOCUMENTS , IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR THE ACCEPTANCE AND IMPLEMENTATION OF SAID GRANT AWARD. WHEREAS, the City of Miami ("City") Department of Public Facilities applied for grant funding from the Florida Boating Improvement Program ("FBIP") for the removal of derelict vessels in City waterways; and WHEREAS, the City's Marine Patrol Unit has identified approximately twenty-four (24) abandoned and derelict vessels in City waterways; and WHEREAS, the twenty-four (24) derelict and abandoned vessels pose a threat to navigational channels and the environment; and WHEREAS, the grant application was approved and awarded to the City in an amount not to exceed $46,000; and WHEREAS, the attached FBIP Grant Agreement provides for a cash match by the City in the amount not to exceed $20,000, which is to be allocated from Capital Improvement Project 40B-30706, and in -kind services for personnel and equipment in the amount of $9,600, to be allocated from the Department of Public Facilities and Miami Police Department's General Fund respectively; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to accept funds, in the amount not to exceed $46,000, consisting of a grant award from FBIP, for the purpose of removing approximately City of Miami Page 1 of 2 File Id: 12-01206 (Version: 1) Printed On: 12/13/2017 File Number: 12-01206 Enactment Number: R-12-0436 twenty-four (24) identified derelict and abandoned vessels in publicly owned City waterways. Section 3. The allocation of the City's matching funds, in the amount of $20,000, from Capital Improvement Project 40-B30706, and in -kind services for personnel and equipment in the amount of $9,600, to be allocated from the Department of Public Facilities and Miami Police Department's General Fund respectively, is authorized. Section 4. The City Manager is further authorized{1 } to execute a FBIP Grant Agreement, in substantially the attached form, and any other necessary documents , in a form acceptable to the City Attorney, for the acceptance and implementation of said grant award. Section 5. The City accepts the terms and conditions set forth in the Florida Fish and Wildlife Conservation Commission's FBIP rules and regulations, which shall be a part of the Grant Agreement for any assistance under the agreement. Section 6. The City is in complete accord with the proposal and agrees to carry out the program in the manner described in the proposal and any plan and specifications attached thereto; unless prior approval for any change has been received from FBIP. Section 7. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
