A RESOLUTION OF THE MIAMI CITY COMMISSION WAIVING, PURSUANT TO
SECTION 62-521(B) (4) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, THE TEMPORARY EVENT TWO (2) EVENT LIMITATION PER
PROPERTY TO ALLOW THE PROPERTY AT 3701 NORTHWEST 7TH STREET,
MIAMI, FLORIDA, TO HOST TEMPORARY EVENTS CONSISTING OF THE SALE
OF CHRISTMAS TREES, SPARKLERS, AND RELATED ITEMS BEGINNING
NOVEMBER 22, 2012 AND ENDING DECEMBER 31, 2012.
WHEREAS, pursuant to Section 62-521, of the Code of the City of Miami, Florida, as amended
("City Code"), Temporary Events are limited to no more than two (2) events per year per property; and
WHEREAS, pursuant to Section 62-521 (b) (4) of the City Code, the number of events can be
waived upon affirmative vote of the City Commission; and
WHEREAS, the property located at 3701 Northwest 7th Street, Miami, Florida, wishes to have a
temporary event from November 22, 2012 to December 31, 2012, for the sale of Christmas trees,
sparklers, and related items; and
WHEREAS, the event will require permits to be issued by the City of Miami ("City") to ensure
life -safety and quality of life issues and appropriate conditions may be imposed on each permit; and
WHEREAS, the proposed temporary event will be beneficial to the City's residents;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. Pursuant to Section 62-521(b) (4), of the City Code, the temporary events amount (no
more than two [2] events per year per property), for the sale of Christmas trees, sparklers, and related
items at the property located at 3701 Northwest 7th Street, Miami, Florida, beginning, November 22,
2012 and ending December 31, 2012, is hereby waived.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1}

{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
