HomeMy WebLinkAboutR-12-0431City of Miami Legislation Resolution: R-12-0431 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-01198 Final Action Date: 11/15/2012 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A FIRST AMENDMENT TO THE PALM BEACH COUNTY SHERIFF'S OFFICE MUTUAL AID AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR THE CITY OF MIAMI'S CONTINUED PARTICIPATION IN ACTIVITIES ASSOCIATED WITH THE INVESTIGATION AND PROSECUTION OF CRIMES RELATED TO PRESCRIBED CONTROLLED SUBSTANCES; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ANY OTHER NECESSARY DOCUMENT, IN ORDER TO IMPLEMENT THE ACCEPTANCE AND ADMINISTRATION OF FUNDS AS STATED IN SAID AGREEMENT. WHEREAS, the City of Miami ("City") entered into a Memorandum of Agreement ("MOA") with the Palm Beach County Sheriffs Office in April, 2012, for the Miami Police Department's sworn members' participation on Region 7 Regional Drug Enforcement Strike Force ("RDESF"); and WHEREAS, pursuant to the executed MOA, the Palm Beach County Sheriff's Office, acting in the capacity as the fiduciary and fiscal agent for funding provided by the Florida Department of Law Enforcement, has obligated funding, to participating agencies for expenditures associated with approved RDESF operations, for the performance period covering April 24, 2012 through June 30, 2012; and WHEREAS, the First Amendment, attached and incorporated, will extend the term of said MOA to December 31, 2012; and WHEREAS, the City is eligible to receive continued reimbursement funding approved by the Co -Chairs of the Region 7 RDESF for activities associated with the investigation and prosecution of crimes related to prescribed controlled substances; and WHEREAS, this extension will allow for continued reimbursement funding to the City's Police Department that will exceed $25,000, and therefore requires City Commission approval; and WHEREAS, no matching funds are required from the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute a First Amendment to the Palm Beach County Sheriff's Office Mutual Aid Agreement, in substantially the attached form, for the City's continued participation in activities associated with the investigation and prosecution of crimes City of Miami Page 1 of 2 File Id: 12-01198 (Version: 1) Printed On: 12/13/2017 File Number: 12-01198 Enactment Number: R-12-0431 related to prescribed controlled substances. Section 3. The City Manager is further authorized{1} to execute any other necessary document, in order to implement the acceptance and administration of funds as stated in said agreement. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
