HomeMy WebLinkAboutLegislation (Version 2) SRSecond Readin Ordinance City of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-01009 Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 2/ARTICLE II OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "MAYOR AND CITY COMMISSION," MORE PARTICULARLY BY AMENDING SECTION 2-32, ENTITLED "TIME AND PLACE OF MEETING," PROVIDING FOR BOTH REGULAR NOVEMBER MEETINGS TO BE HELD ON THE THIRD THURSDAY OF NOVEMBER AND FOR BOTH REGULAR DECEMBER MEETINGS TO BE HELD ON THE SECOND THURSDAY OF DECEMBER; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Chapter 2/Article II of the City Code, is amended in the following particulars:{1} "CHAPTER 2 ADMINISTRATION ARTICLE II MAYOR AND CITY COMMISSION Sec. 2-32. - Time and place of meeting. (a) The city hall, located at Dinner Key, Miami, Florida, is hereby designated as the meeting place for the city commission; and its regular meetings, as hereinafter designated, shall be held on the first floor of the city hall. The city commission is hereby authorized to designate alternate meeting placesand times from time to time as may appear appropriate. Such alternate meeting places shall be designated by resolution. Such resolution shall specify the date, time and place for not more than one regular city commission meeting. The date so specified shall be not sooner than 30 days subsequent to the effective date of the resolution. (b.) Regular meetings of the city commission shall be held on the second and fourth Thursdays of each month except during the month of August and unless otherwise provided by city commission action. All rRegular meetings of the city commission shall convene promptly at 9:00 a.m. However, during November, the regular meetings shall be held one after another on the third Thursday of the month at 9:00 a.m. and 2:00 p.m, and .during December, the regular meetings shall be held one after another, on the second Thursday of the month at 9:00 a.m. and 2:00 p.m. At the first meeting of the month, matters to be considered shall be generally limited to those matters not arising from or under the provisions of Ordinance Number 11000 Miami 21, as amended, the comprehensive zoning ordinance for the City of Miami. At the second monthly meeting, matters to be considered shall be City of Miami Page 1 of 2 File Id: 12-01009 (Version: 2) Printed On: 10/11/2012 File Number: 12-01009 generally limited to those matters arising from or under the provisions of Ordinance Number 11000 Miami 21. Further, all public hearings on land use ordinances, including those involving ten (10) acres or more, may be held before 5:00 p.m. unless the city commission, state law or administrative rule specifically provide otherwise. Nothing herein shall preclude consideration of any matter at any meeting whether or not such matter arises from or under the provisions of said Ordinance Number 11000 Miami 21. (c) However, the city commission may, by resolution, designate a substitute day or time upon which regular city commission meetings shall be held whenever, in the opinion of a majority of the members of the city commission, there is good cause for such substitution. Section 2. If any section, part of a section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 3. This Ordinance shall become effective immediately after its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: CITY ATTORNEY Footnotes: {1} Words/and or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
