Background
On May 24, 2012, Capital Improvements Program ("CIP") issued Request for Proposals ("RFP")
No. 11-12-033 for the provision of Design -Build Services for Seawall Stabilization and Repair at
Museum Park; Project No.: B-30538 (the "Project").
On June 2, 2012, CIP received one (1) Proposal for the Project from Ebsary Foundation
Company ("Ebsary"). CIP staff reviewed the Company's Proposal and determined that (a)
Ebsary meets the minimum requirements for responding to the RFP and (b) their Proposal is
responsive to the solicitation.
On July 23, 2012, Atkins, North America, Inc., the City's Design Criteria Professional, concurred
with CIP's due diligence findings after conducting a detailed responsiveness analysis of
Ebsary's technical proposal (see attached).
On Thursday, July 26, 2012, the Committee met, evaluated and scored Ebsary and its Proposal
based on the following six (6) components, as stated in the RFP.

2. Qualifications and Experience of the Proposer (maximum 6 points)
3. Design and Construction Approach Process (maximum 6 points)
4. Qualifications of the:
Project Manager and Construction Manager (maximum 6 points)
5. Technical Capabilities (maximum 6 points)

The result of the Committee meeting is as follows:

Findings
On August 13, 2012, CIP received approval from the City Manager to enter into negotiations
with Ebsary for completion of the Project.
On September 6, 2012, Jeovanny Rodriguez, P.E, Assistant Director of CIP met with Matt J.
Shiring, P.E., Vice -President of Ebsary Foundation Company. The purpose of the meeting was
to negotiate the Price Proposal without any modifications to the Scope of Work, RFP or the
Design Criteria Package.
Ebsary agreed to revisit the Price Proposal and resubmit a best and final Guaranteed Maximum
Price ("GMP") proposal to CIP.
On September 21, 2012, CIP received the GMP proposal from Ebsary in the amount of
$2,369,250. (See attached).
Recommendation
The result of the negotiations conducted by CIP resulted in a cost savings to the City in the
amount of $166,750.00. Having determined that Ebsary was the sole, responsive and
responsible Proposer, CIP recommends that the Project be awarded to Ebsary Foundation
Company.
Upon City Commission approval, CIP will present the Contract to the City Commission for
award to Ebsary Foundation Company in the amount of Ebsary's GMP of $2,369.250.00,
including a ten percent (10%) contingency for a total Contract amount not to exceed
$2,606,175.
Your signature below will signify your concurrence with the above recommendation and your
assimilation of these findings as your own justification based on the requirements of the RFP
and the qualifications of the Proposers.
