HomeMy WebLinkAboutO-13339City of Miami Legislation Ordinance: 13339 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-00845 Final Action Date: 9/27/2012 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 18/ARTICLE III OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "FINANCE/CITY OF MIAMI PROCUREMENT ORDINANCE", MORE PARTICULARLY BY CREATING NEW SECTION 18-110, ENTITLED , "ADOPTION OF FLORIDA VETERAN BUSINESS ENTERPRISE OPPORTUNITY ACT", WHICH ADOPTS BY REFERENCE, THE FLORIDA VETERAN BUSINESS ENTERPRISE OPPORTUNITY ACT , PROVIDING A VENDOR PREFERENCE IN THE MANNER PROVIDED BY THIS STATE ACT ; PROVIDING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, it is the intent of the Miami City Commission to try to alleviate the economic disadvantages of service -disabled veterans through contracts subject to City of Miami ("City") purchasing procedures; and WHEREAS , certain data has indicated that veterans are least likely to be self-employed when compared to the general civilian population and that they have made extraordinary sacrifices on behalf of the nation, the State, the City and the public; and WHEREAS, the City would like to provide opportunities for certified veterans' business enterprises in substantially the same manner set forth in Florida Statutes; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section. 1 The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 18/Article III of the Code of the City of Miami, Florida, as amended, is amended in the following particulars:{1} "CHAPTER 18 FINANCE ARTICLE III. Adoption of Florida Veteran Business Enterprise Opportunity Act. (a) The City of Miami hereby adopts Florida Statute Section 295.187, the "Florida Veteran Business Enterprise Opportunity Act", as amended, and incorporates it by reference into the City of Miami Procurement Ordinance, as such may be modified or amended from time to time. (b) Definitions. For purposes of this Section the following words shall have the same meanings ascribed to them as in "Florida Veteran Business Enterprise Opportunity Act", as amended: (1) "Certified veteran business enterprise . (2) "Service -disabled veteran ". (3) "Veteran business enterprise". (4) "Wartime veteran ". (c ) The City of Miami, after applying the local preference provided in the City of Miami Procurement Ordinance, when considering two or more bids, proposals or other replies for the procurement of goods, equipment and contractual services, at least one of which is from a certified veteran business enterprise, which are equal with respect to all relevant considerations, including, without limitation, price, quality, and service , shall award such procurement or contract to the certified veteran business enterprise. (d ) If a certified veteran business enterprise entitled to the vendor preference under this section and one or more businesses entitled to this preference as provided in this section or another vendor preference under the City of Miami Procurement Ordinance submit bids, proposals, or replies for procurement of goods, equipment and contractual services which are equal with respect to all relevant considerations, including price, quality, and service, the city shall award the procurement or contract to the business having the smallest net worth. Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof.{2} Footnotes: {1} Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
