HomeMy WebLinkAboutR-12-0366City of Miami Legislation Resolution: R-12-0366 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-01117 Final Action Date: 9/27/2012 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY CLERK TO WORK WITH THE MIAMI-DADE COUNTY ("COUNTY") DEPARTMENT OF ELECTIONS TO PROVIDE PRE -PAID POSTAGE FOR THE RETURN OF ABSENTEE BALLOTS WITHIN THE CITY OF MIAMI, DURING CITY-WIDE ELECTIONS NOT IN LINE WITH A COUNTY -WIDE ELECTION. WHEREAS, Miami -Dade County ("County"), and the City of Miami ("City"), recently have experienced examples of alleged absentee ballot fraud; and WHEREAS, absentee ballot fraud is typically associated with ballot brokers who seek to influence innocent absentee voters by, among other methods, offering to pay the cost of postage for the return of absentee ballots to the Miami -Dade Supervisor of Elections; and WHEREAS, providing pre -paid postage for the return of absentee ballots will decrease the ability of ballot brokers to illegally influence voters in the City; and WHEREAS, the right to vote is a fundamental right in a democracy and should not be impeded by the payment of any costs such as postage; and WHEREAS, the cost for providing pre -paid postage would not exceed seventeen thousand dollars ($17,000) in any City-wide election not in line with a County -wide election; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. It shall be the policy of the Miami City Commission to provide pre -paid postage for all absentee ballots sent out by the Supervisor of Elections in City-wide elections not in line with a County -wide election. Section 3. The City Clerk is directed to to work with the Miami -Dade County Department of Elections for those elections commencing with the November 6, 2012 general election. Section 4. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
