CLOSING, VACATING, ABANDONING AND DISCONTINUING FOR PUBLIC USE AN ALLEY
LOCATED BETWEEN BISCAYNE BOULEVARD AND NORTHEAST 2nd AVENUE AND
BETWEEN NORTHEAST 20th TERRACE AND NORTHEAST 21st STREET "BRAMAN BMW"
SUBDIVISION
Pursuant to Section 55-15 (c) of the Miami City Code, the Planning Department has
reviewed the proposed public right-of-way vacation and closure to determine whether it
is in the public interest, or whether the general public would benefit from the vacation of
the right-of-way.
The following findings have been made:
It is found that the existing alley is private and the general public does not utilize the
alley. The proposed closure of the alley will create a unified development site that
may be developed under Miami 21 Code regulations that will provide public access
and a Cross -Block Pedestrian Passage.
• It is found that the general public does not use the alley and emergency vehicles do
not use the alley. Solid waste collection is private in this district and City service
vehicles do not use the alley.
• It is found that Police, Fire and emergency services are not affected by the alley
closure. The site is adequately served from the four public streets abutting the
perimeter of the site. The development of the site under Miami 21 Code regulations
requires review by Police and Fire/Rescue Departments to determine if emergency
access routes will be required as part of the future development permits.

It is found that the existing private alley is not part of the vehicular and pedestrian
traffic circulation network for the neighborhood. The unification of the site and future
development under Miami 21 Code regulations requires new pedestrian circulation
and access corridors to better serve the general public.
• It is found that the Plat and Street Committee members voted 7 in favor and 0 in
denial of this alley closure request.
Based on these findings, the Planning and -Zoning Department recommends
approval of the request.

The Plat and Street Committee has reviewed the tentative plat of "BRAMAN BMW" subdivision and
determined that all technical requirements contained in the Miami City Code Subdivision Regulations
have been met and has approved the tentative plat. The Plat and Street Committee has further
considered the vacation and closure of an alley with respect to the Miami City Code requirements and
has voted to recommend 7 in favor and 0 in denial of this vacation and closure request.

RECOMMENDING APPROVAL TO THE MIAMI CITY COMMISSION, CLOSING,
VACATING, ABANDONING AND DISCONTINUING FOR PUBLIC USE AN ALLEY
BETWEEN BISCAYNE BOULEVARD AND NORTHEAST 2ND AVENUE AND
BETWEEN NORTHEAST 20TH TERRACE AND NORTHEAST 21ST STREET, MIAMI,
FLORIDA, PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA.
Upon being seconded by Mr. Patrick Goggins, the motion passed and was adopted by a
vote of 10-0:
