HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-00904 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION URGING THE FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT") TO GRANT URBAN MUNICIPALITIES LOCAL CONTROL OVER THE CHARACTER OF STATE ROADS NOT CLASSIFIED AS LIMITED ACCESS FACILITIES WITHIN THEIR JURISDICTION, FOR MUNICIPALITIES WITH A POPULATION DENSITY OF TEN THOUSAND (10,000) PEOPLE PER SQUARE MILE OR MORE, WITH FDOT TO PROVIDE THE FUNDS ALLOCATED TO SAID FACILITIES DIRECTLY TO THE MUNICIPALITIES IN WHICH THE STATE ROAD IS LOCATED; DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE OFFICIALS AS STATED HEREIN. WHEREAS, the City of Miami, and other similarly situated, dense urban municipalities in South Florida have road transportation needs dissimilar from more suburban and rural portions of Florida; and WHEREAS, strict adherence to the Florida Department of Transportation's ("FDOT's") methodology for the design and configuration of roads often leads to high-speed, over -sized roads that are out of character with the urban streetscape surrounding them; and WHEREAS, FDOT's standards for road design place greater emphasis on cars moving through neighborhoods rather than those people working and residing in those neighborhoods; and WHEREAS, FDOT's methods may work well in the suburbs and rural areas that make up a vast majority of Florida; and WHEREAS, cities have unique transportation and planning needs that cannot be met by a one -size -fits -all plan promulgated by FDOT which only focuses on moving cars to the detriment of pedestrians and viable, vibrant urban areas; and WHEREAS, urban municipalities such as Miami with high population densities should be granted discretion to determine the character of streets within their boundaries to best promote the health, welfare, and safety of its citizenry; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Miami City Commission respectfully request that FDOT officials grant local control to the City of Miami over the character of the State Roads not classified as Limited Access Facilities as City of Miami Page 1 of 2 File Id: 12-00904 (Version: 1) Printed On: 8/30/2012 File Number: 12-00904 those terms are defined in Section 334.03, Florida Statutes, in considering delegation of authority over .State Road planning, design, improvements, maintenance and modifications to urban municipalities such as the City of Miami which have a population density of ten thousand (10,000) per square mile or more when such road is within the City of Miami limits. This same delegation is encouraged for other urban cities in South Florida who have a similar population density and further have State Roads within their city limits. Section 3. The Miami City Commission respectfully requests FDOT to provide funding and similar assistance to the City of Miami to effectuate the delegation of authority requested by this Resolution. Section 4. The City Clerk is directed to transmit a copy of this Resolution to Ananth Prasad, Secretary of the Florida Department of Transportation and Gus Pego, Florida Department of Transportation District 6 Secretary. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} APPROVED AS TO FORM AND CORRECTNES�� CITY ATTORNEY Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
