HomeMy WebLinkAboutR-12-0304City of Miami Legislation Resolution: R-12-0304 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-00854 Final Action Date: 9/13/2012 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A GRANT OF EASEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, TO THE FLORIDA DEPARTMENT OF TRANSPORTATION, FOR A PERPETUAL, NON-EXCLUSIVE EASEMENT OF APPROXIMATELY FOUR HUNDRED SEVENTY SIX (476) SQUARE FEET OF CITY OF MIAMI OWNED PROPERTY LOCATED AT THE INTERSECTION OF NORTHWEST 20TH STREET AND NORTHWEST 12TH AVENUE, MIAMI, FLORIDA, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A", ATTACHED AND INCORPORATED, FOR THE CONSTRUCTION, MAINTENANCE AND WIDENING OF THE CORNER RADIUS, THE RECONSTRUCTION OF THE CURB, GUTTER, SIDEWALK AND CURB RAMPS, AND THE INSTALLATION OF DRAINAGE. WHEREAS, the State of Florida Department of Transportation ("FDOT") proposes to construct or improve State Road No. 933, Section No. 4284802, in Miami -Dade County, Florida; and WHEREAS, FDOT has requested the grant of easement of approximately a four hundred seventy six (476) square feet of City of Miami ("City") owned property located at the intersection of Northwest 20th Street and Northwest 12th Avenue, Miami, Florida; and WHEREAS, it is necessary that an easement across certain lands now owned by the City be acquired by the FDOT: and WHEREAS, said use is in the best interest of the City; and WHEREAS, FDOT has made an application to execute and deliver to FDOT a perpetual easement, or easements, in favor of FDOT for the purpose of constructing, maintaining and widening the corner's radius return, which will involve the reconstruction of the curb, gutter, sidewalk and curb ramps, the installation of drainage, the relocation of an existing light pole, and the installation of a new mast arm and associated wiring, conduits, and pull -boxes; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute a Grant of Easement, in substantially the attached form, to the FDOT, for a perpetual, non-exclusive easement of approximately four hundred seventy six (476) square feet of City -owned property located at the intersection of Northwest 20th Street and Northwest 12th Avenue, Miami, Florida, as more particularly described in Exhibit "A", attached and incorporated, for the construction, maintenance and widening of the corner radius, the reconstruction of the curb, gutter, sidewalk and curb ramps, and the installation of drainage. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
