HomeMy WebLinkAboutR-12-0300City of Miami Legislation Resolution: R-12-0300 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-00893 Final Action Date: 9/13/2012 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT TWO TO THE FISCAL YEAR 2005 COMMUNITY DEVELOPMENT BLOCK GRANT ("CDBG") DISASTER RELIEF INITIATIVE ROUND II CONTRACT BETWEEN MIAMI- DADE COUNTY AND THE CITY OF MIAMI, IN SUBSTANTIALLY THE ATTACHED FORM, EXTENDING THE CONTRACT FROM JUNE 30, 2012 TO DECEMBER 31, 2012, FOR THE PURPOSE OF PROVIDING CDBG FUNDS, IN THE AMOUNT OF $2,305,848, FOR DISASTER RECOVERY IN THE AREAS OF HOUSING AND INFRASTRUCTURE REPAIR OR IMPROVEMENT UNDER THE MILITARY CONSTRUCTION APPROPRIATIONS AND EMERGENCY HURRICANE SUPPLEMENTAL APPROPRIATIONS ACT, A/K/A DISASTER RECOVERY PROGRAM, FROM THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ANY FUTURE AMENDMENTS AS MAY BE NEEDED. WHEREAS, pursuant to the Military Construction Appropriations and Emergency Hurricane Supplemental Appropriations Act, Community Development Block Grant ("CDBG") disaster relief funding was made available to the State of Florida by the United States Department of Housing and Urban Development; and WHEREAS, in 2006, Miami -Dade County ("County") was allocated the amount of $16,000,000, to be shared by all municipalities in the County based on need and the project of which the City of Miami ("City") was awarded $2,000,000; and WHEREAS, in August of 2007, the County received an additional $22 million under the same appropriation for projects in the County; and WHEREAS, pursuant to Resolution No. 10-0357, adopted September 16, 2010, the City Commission accepted said funds; and WHEREAS, the City and the County executed a CDBG Disaster Relief Initiative ("DRI") Round II contract in the amount of $2,776,264, for projects which have been pre -approved by the County; and WHEREAS, pursuant to Resolution No. 12-0166, adopted April 12, 2012, the City Commission authorized the recapture of $470,416 of the $2,776,264 and authorized the County to allocate $315,309 of the CDBG DRI funds to the City under a separate contract for the rehabilitation of the Town Park Village I Project that suffered hurricane damage; and WHEREAS the attached amendment providing for an extension will provide the projects ample time to complete construction; and WHEREAS, the City Administration recommends the approval of Amendment Two to the Round II City of Miami Page 1 of 2 File Id: 12-00893 (Version: 11 Printed On: 11/29/2017 File Number: 12-00893 Enactment Number: R-12-0300 CDBG DRI Contract between the County and the City, in substantially the attached form, and the extension of the contract from June 30, 2012 to December 31, 2012 for the for disaster recovery in the areas of housing and infrastructure repair or improvement in the total amount of $2,305,848 under the Military Construction Appropriations and Emergency Hurricane Supplemental Appropriations Act, a/k/a Disaster Recovery Program, from the United States Department of Housing and Urban; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute Amendment Two to the Fiscal Year 2005 CDBG DRI Round II Contract between the County and the City, in substantially the attached form, extending the contract from June 30, 2012 to December 31, 2012, for the purpose of providing CDBG funds, in the amount of $2,305,848, for disaster recovery in the areas of housing and infrastructure repair or improvement under the Military Construction Appropriations and Emergency Hurricane Supplemental Appropriations Act, a/k/a Disaster Recovery Program, from the United States Department of Housing and Urban Development. Section 3. The City Manager is further authorized{1} to execute any future amendments as may be needed. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
