HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-00891 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING THE CONVEYANCE, WITH PARCEL REVERTER PROVISIONS, OF THE CITY OF MIAMI OWNED PROPERTIES LOCATED AT 2525 NORTHWEST 34TH STREET, MIAMI, FLORIDA AND 1924 NORTHWEST 26TH STREET, MIAMI, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A", ATTACHED AND INCORPORATED, TO ALLAPATTAH BUSINESS DEVELOPMENT AUTHORITY, INC..:, FOR THE PURPOSE OF DEVELOPMENT AND MANAGEMENT OF AFFORDABLE HOUSING FOR LOW TO MODERATE INCOME FAMILIES; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, on June 30, 2008, President George W. Bush signed the Housing and Economic Recovery Act of 2008, which appropriated $3.92 billion for assistance to state and local governments for the redevelopment of abandoned and foreclosed homes under the Neighborhood Stabilization Program ("NSP"); and WHEREAS, the City of Miami ("City") was awarded $12,063,702 of this federal funding to acquire, rehabilitate, and re-sell/rent lender -foreclosed properties to income eligible buyers and renters; and WHEREAS, pursuant to Resolution No. 08-0641, adopted November 13, 2008, the City Commission approved the acceptance of these funds from the United States Department of Housing and Urban Development for the implementation of the NSP; and WHEREAS, pursuant to Resolution No. 08-0642, adopted November 13, 2008, the City Commission approved the NSP plan which included the purchase and rehabilitation of single and multi -family properties as a neighborhood stabilization strategy; and WHEREAS, said properties were acquired with NSP funds and the rehabilitation of the property located at 2525 Northwest 34th Street, Miami, Florida, is 90% complete and the property located at 1924 Northwest 26th Street, Miami, Florida, is pending rehabilitation; and WHEREAS, it is in theebest interest of the City to allow a non-profit community based organization to develop and manage these properties; and WHEREAS, Allapattah Business Development Authority, Inc. ("ABDA"), is the primary affordable housing non-profit organization and certified Community Housing Development Organization, doing business in the Allapattah neighborhood; and WHEREAS, the City Administration recommends the conveyance, with parcel reverter provisions, City of Mianri Page 1 of 2 File Id: 12-00891 (Version: 1) Printed On: 8/30/2012 File Number: 12-00891 of the City owned properties located at 2525 Northwest 34th Street, Miami, Florida and 1924 Northwest 26th Street, Miami, Florida, as legally described in Exhibit "A", attached and incorporated, to ABDA, for the development and management of affordable housing for Low to Moderate Income families as defined under the NSP; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The conveyance, with parcel reverter provisions, of the City -owned properties located at 2525 Northwest 34th Street, Miami, Florida and 1924 Northwest 26th Street, Miami, Florida, as legally described in Exhibit "A", attached and incorporated, to ABDA, for the purpose of the development and management of affordable housing for Low to Moderate Income families, is approved. Section 3. The City Manager is authorized {1} to execute all necessary documents, in a form acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JULIE BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
