Purpose of Item: An Ordinance amending Chapter 18, Article III of the Code of the City of Miami, Florida, as amended, entitled "Finance/City of Miami Procurement Ordinance", more particularly by amending Section 18-87 and Section 18- 89 to establish Community Business Enterprise (CBE) and Community Small Business Enterprise (CSBE) participation requirements for competitively procured contracts. This item passed on first reading on June 28, 2012. Background Information: The City of Miami (City) Procurement Ordinance currently does not include a CBE or CSBE requirement for competitively procured contracts. The City deems a CBE and CSBE requirement for competitively procured contracts would increase the participation of small businesses on City contracts. The City seeks to establish a CBE requirement for competitively procured contracts under Section 18-87 for professional services which requires Respondents to assign a minimum of fifteen percent (15%) of the contract value to firms currently certified by Miami -Dade County as CBEs. Respondents shall place a specific emphasis on utilizing local small businesses from within the City's municipal boundaries. Request for Proposals (RFP), Request for Letters of Interest (RFLI), and Request for Qualifications (RFQ) shall include provisions in its evaluation criteria that award five (5) bonus points to respondents who meet the CBE participation requirement through use of the Firms from within the City's municipal boundaries. Director City Manager N/ Page 1 of 2 In addition, the City seeks to establish a CSBE requirement for competitively procured contracts under Section 18-89 for public works or improvements which requires Respondents to assign a minimum of fifteen percent (15%) of the contract value to fines currently certified by Miami -Dade County as CSBEs. Respondents shall place a specific emphasis on utilizing local small businesses from within the City's municipal boundaries. Five percent (5%) of the bid amount shall be retained by the City for the CSBE participation requirements until said requirements are fulfilled and verified by the City as being fulfilled within six (6) months of contract completion. Failure to satisfactorily meet, document, and present to the City the CSBE requirements within six (6) months of contract completion shall result in the forfeiture of the retained amount to the City.
