A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
ATTORNEY TO TAKE ANY AND ALL ACTIONS AUTHORIZED IN LAW OR IN
EQUITY NECESSARY OR PERMITTED TO REGAIN POSSESSION OF CITY OF
MIAMI ("CITY") OWNED PROPERTY LOCATED AT 60 SOUTHEAST 4TH STREET,
MIAMI, FLORIDA, AND TO RECOVER ALL DAMAGES WHICH THE CITY HAS
SUSTAINED AS A RESULT OF MIAMA RIVER GROUP, INC.'S BREACH OF THE
RESTAURANT AGREEMENT EXECUTED ON MARCH 23, 1988, INCLUDING ANY
AND ALL SUBSEQUENT AMENDMENTS AND MODIFICATIONS.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The City Attorney is directed to take any and all actions, necessary or permitted to
regain possession of City of Miami ("City") owned property located at 60 Southeast 4th Street, Miami,
Florida (also known as Fort Dallas Park), and to recover all damages which the City has sustained as
a result of Miama River Group's (operating as Bijan's) breach of the Restaurant Agreement executed
on March 23, 1998, including any and all subsequent amendments and modifications.
Section 2. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1}

Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
