HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-00732 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A USE AGREEMENT ("USE AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE MIAMI ART MUSEUM OF DADE COUNTY ASSOCIATION, INC., FOR THE USE OF STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION PARCEL NO. RWMS 3991, LOCATED ON THE SOUTH SIDE OF THE MACARTHUR CAUSEWAY RAMP BETWEEN BISCAYNE BAYAND BISCAYNE BOULEVARD, MIAMI, FLORIDA, FOR PUBLIC PURPOSES CONSISTENT WITH THE MUSEUM PARK MASTER PLAN, WITH ALL TERMS AND CONDITIONS AS MORE PARTICULARLY SET FORTH IN SAID USE AGREEMENT. WHEREAS, the Florida Department of Transportation ("FDOT") owns certain property located on the south side of the MacArthur Causeway Ramp between Biscayne Bay and Boulevard in Miami, Florida ("Property"); and WHEREAS, the City of Miami ("City") and the Miami Art Museum of Dade County Association, Inc. ("MAM") entered into a Lease Agreement on April 6, 2009 for the use of City -owned property located at 1075 Biscayne Boulevard, Miami, Florida, as part of the Miami Art Museum Project; and WHEREAS, the City is interested in occupying the Property for public purposes consistent with the Museum Park Master Plan, such as construction staging for the Miami Art Museum, landscaping, directional signage and access by the public to the public bay walk; and WHEREAS, the City and MAM desire to enter into a Use Agreement ("Use Agreement") for MAM's use of the Property; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute a Use Agreement, in substantially the attached form, with MAM, for the use of FDOT Parcel No. RWMS 3991, located on the Property, for the public purposes consistent with the Museum Park Master Plan, with all terms and conditions as more particularly set forth in said Use Agreement. Section 3. Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
