Directo Chief City Manager $50.00 and $600.00 (FY12 & FY13, respectively) Final Approvals (SIGN AND DATE) Page 1 of 2 Subject: Revocable License Agreement with Allapattah Community Action, Inc. for the occupancy of City of Miami -owned property located at 1836 NW 22 Place Background Information: The Licensee currently occupies the Property under a Revocable License Agreement that began on August 13, 2002 and will end on August 12, 2012. The Licensee uses the Property to operate a child care program that receives funding from Head Start and the United States Department of Agriculture ("USDA"). The Head Start program, funded by the United States Department of Health and Human Services as a pass through to Miami - Dade County's Community Action Agency, is a program aimed at providing pre-school children with a daily education program emphasizing the social, physical and cognitive skills appropriate for pre-school age children. The USDA program provides funding so that two meals and one supplement are provided to the children attending Licensee's child care program. The Licensee is a provider of the State of Florida Voluntary Pre-K Education Program. The City of Miami and the Licensee desire to enter into a new Revocable License Agreement ("Agreement") so that the Licensee can continue to provide services to qualifying children. The City and the Licensee have a negotiated the terms of the Agreement, which includes such terms as the Licensee occupying the Property term of one year, with an option to renew for nine additional one-year terms, remitting a monthly Use Fee payment to the City of $50.00, plus State of Florida Use Tax (if applicable), creating and maintaining a special Reserve/Maintenance Fund, providing audited financial statements, and other additional terms and condition more specifically set forth in the Agreement.
