A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A REVOCABLE LICENSE
AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM,
BETWEEN THE CITY OF MIAMI ("CITY") AND ALLAPATTAH COMMUNITY
ACTION, INC., A FLORIDA NON-PROFIT CORPORATION ("LICENSEE'), FOR
THE USE OF APPROXIMATELY 5,293 SQUARE FEET OF CITY -OWNED
PROPERTY LOCATED AT 1836 NORTHWEST 22 PLACE, MIAMI, FLORIDA, FOR
THE PURPOSE OF PROVIDING A CHILD CARE PROGRAM, COMMENCING
FROM THE EFFECTIVE DATE, WITH THE LICENSEE TO PAYA MONTHLY USE
FEE TO THE CITY OF FIFTY DOLLARS ($50.00), PLUS STATE OF FLORIDA USE
TAX (IF APPLICABLE), WITH ADDITIONAL TERMS AND CONDITIONS AS MORE
PARTICULARLY SET FORTH IN SAID AGREEMENT.
WHEREAS, the City of Miami, Florida ("City") owns that certain property, and the
improvements thereon, located at 1836 Northwest 22 Place, Miami, Florida ("Property"); and
WHEREAS, Allapattah Community Action, Inc. ("Licensee") currently uses the Property to
operate a child care program; and
WHEREAS, the Licensee's current Revocable License Agreement with the City will terminate
on August 12, 2012; and
WHEREAS, the Licensee has expressed its interest of continuing to use the Property for
providing the child care program; and
WHEREAS, the City and the Licensee desire to enter into a Revocable License Agreement
("Agreement") for the Licensee's use of the Property;
NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as fully set forth in this Section.
Section 2. The City Manager is authorized {1} to execute an Agreement, in substantially the
attached form, between the City the Licensee, for the use of the Property, for the purpose of providing
a child care program, commencing from the Effective Date, with the Licensee to pay a monthly Use
Fee to the City of Fifty Dollars ($50.00), plus State of Florida Use Tax (if applicable), with additional
terms and conditions as more particularly set forth in said Agreement.
Section 3. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
