Enclosed you will find an ad for notice of a public hearing to be held by the City Commission on July 12, 2012, for the purpose of authorizing a Lease Agreement between the City of Miami ("City") and CHLN, Inc. for a period of twenty (20) years, with two five-year renewal terms. IracP CITY OF MIAMI, FLORIDA NOTICE OF PUBLIC HEARING A public hearing will be held by the City Commission of the City of Miami, Florida on July 12, 2012, at 9:00 AM at City Hall, located at 3500 Pan American Drive, Miami, Florida, for the purpose of authorizing the following: A RESOLUTION OF THE MIAMI CITY COMMISSION, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER APPROVING THE FINDINGS OF THE SELECTION COMMITTEE, PURSUANT TO REQUEST FOR PROPOSALS NO. 11-12-024, THAT CHLN, INC., ("SELECTED PROPOSER"), IS THE TOP RANKED COMPANY SELECTED FOR THE LEASE, RENOVATION, MANAGEMENT AND OPERATION OF THE INDOOR/OUTDOOR RESTAURANT LOCATED AT 51 CHART HOUSE DRIVE, MIAMI FL. 33133; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A LEASE AGREEMENT ("AGREEMENT"), SUBJECT TO THE REVIEW AND APPROVAL OF THE OFFICE OF THE CITY ATTORNEY, FOR AN INITIAL PERIOD OF TWENTY (20) YEARS, WITH TWO (2) FIVE YEAR RENEWAL TERMS; WITH PAYMENT OF THE GREATER OF, A MINIMUM ANNUAL BASE RENT OF $340,000.00 PAYABLE ON A MONTHLY BASIS OR PERCENTAGE RENT, WITH TERMS AND CONDITIONS MORE PARTICULARLY SET FORTH IN THE AGREEMENT; FURTHER AUTHORIZING THE CITY MANAGER TO MAKE NON -SUBSTANTIVE AMENDMENTS TO THE AGREEMENT AS NEEDED. All interested persons are invited to appear and may be heard concerning this item. Should any person desire to appeal any decision of the City Commission with respect to any matter considered at this hearing, that person shall ensure that a verbatim record of the proceedings is made, including all testimony and evidence upon which any appeal may be based (F.S.286.0105).
