A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER, AFTER CONSULTATION WITH THE CITY ATTORNEY, TO EXECUTE
AMENDMENT SIX TO THE FISCAL YEAR 2005 COMMUNITY DEVELOPMENT
BLOCK GRANT DISASTER RELIEF INITIATIVE ROUND I CONTRACT BETWEEN
MIAMI-DADE COUNTY AND THE CITY OF MIAMI, EXTENDING THE CONTRACT
FROM JULY 31, 2012 TO DECEMBER 31, 2012, UNDER THE MILITARY
CONSTRUCTION APPROPRIATIONS AND EMERGENCY HURRICANE
SUPPLEMENTAL APPROPRIATIONS ACT, ALSO KNOWN AS DISASTER
RECOVERY PROGRAM, FROM THE UNITED STATES DEPARTMENT OF
HOUSING AND URBAN DEVELOPMENT.
WHEREAS, pursuant to the Military Construction Appropriations and Emergency Hurricane
Supplemental Appropriations Act, Community Development Block Grant ("CDBG") disaster relief
funding was made available to the State of Florida by the United States Department of Housing and
Urban Development for damages caused by Hurricane Katrina; and
WHEREAS, Miami -Dade County ("County") was allocated the amount of $16,000,000, to be
shared by all municipalities in the County based on need and the project; and
WHEREAS, pursuant to Resolution No. 07-0131, adopted March 8, 2007, the Miami City
Commission gave the City Manager the authority to accept a CDBG grant award in the amount of
$2,000,000 from the County, for the City of Miami's ("City") Disaster Recovery Program; and
WHEREAS, said funds will be utilized to provide rehabilitation assistance to multi -family properties
that were damaged due to the hurricane; and
WHEREAS, on September 11, 2007, the Fiscal Year ("FY") 2005 CDBG Disaster Relief Initiative
("DRI") contract between the City and the County was executed for the purpose of providing CDBG
funds for the rehabilitation of the multi -family properties with an expiration date of June 30, 2008; and
WHEREAS, on September 6, 2008, the City and the County executed an amendment extending
the FY 2005 CDBG DRI contract date from June 30, 2008 to December 31, 2008; and
WHEREAS, pursuant to Resolution No. 09-0216, adopted May 14, 2009, the Miami City
Commission gave the City Manager authority to execute an additional amendment to the FY 2005
CDBG DRI contract, granting an extension from June 30, 2008 to December 31, 2009; and
WHEREAS, pursuant to Resolution No. 10-0086, adopted February 25, 2010, Miami City
Commission gave the City Manager authority to execute an additional amendment to the FY 2005
CDBG DRI contract, granting an extension from December 31, 2009 to June 30, 2010; and

WHEREAS, pursuant to Resolution No. 10-0537, adopted December 16, 2010, the Miami City
Commission gave the City Manager authority to execute an additional amendment to the FY 2005
CDBG DRI contract, granting an extension from June 30, 2010 to June 30, 2011; and
WHEREAS, on November 30, 2011, an additional amendment to the FY 2005 CDBG DRI contract
was executed to extend the expiration date from June 30, 2011 to December 31, 2011; and
WHEREAS, to date 241 units of housing have been assisted through the City's Disaster Recovery
Program; and
WHEREAS, pursuant to Resolution No. 12-0165, adopted April 12, 2012, the City Commission
approved an extension to the FY 2005 CDBG DRI contract to July 31, 2012 for the purpose of
providing additional CDBG funds received under the Military Construction Appropriations And
Emergency Hurricane Supplemental Appropriations Act, a/k/a Disaster Recovery Program, from the
United States Department of Housing and Urban Development, in the amount of $470,416, for the
rehabilitation of the Town Park Village I project that suffered hurricane damage; and
WHEREAS, the State, through the County, has extended the Disaster Recovery Program from
July 31, 2012 to December 31, 2012, and
WHEREAS, the City Administration recommends the approval of an extension to the FY 2005
CDBG DRI contract between the County and the City for the City's Disaster Recovery Program from
July 31, 2012 to December 31, 2012; and acceptance of the additional CDBG funds in the amount of
$470,416 for the rehabilitation of the Town Park Village I project, further authorizing the City Manager
to execute Amendment Six to the FY 2005 CDBG DRI contract for the extension and acceptance of
the additional CDBG funds;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized {1} execute Amendment Six to the FY 2005 CDBG DRI
Round I contract between the County and the City, extending the contract from July 31, 2012 to
December 30, 2012, for the purpose of providing additional CDBG funds received under the Military
Construction Appropriations and Emergency Hurricane Supplemental Appropriations Act, a/k/a
Disaster Recovery Program, from the United States Department of Housing and Urban Development,
in the amount of $2,470,416, for the rehabilitation of projects that suffered hurricane damage.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
