ANALYSIS FOR ZONING CHANGE
approximately at 1204 and 1208 SW 8t" Street, 810 and 832 SW 12th Avenue

Pursuant to Article 5 and Article 7, Section 7.1.2.8 of Ordinance 13114, as amended, the Zoning Ordinance
of the City of Miami, Florida, the subject proposal has been reviewed for an amendment to the Zoning Atlas
as follows:
Application requests:
The request is to change the zoning classifications for three parcels from T6-8-0 "Urban Core
Transect Zone - Open" and one parcel from T4-L "General Urban Transect Zone- Limited" to T5-0
"Urban Center Transect Zone - Open".
The subject properties are located within the Coral Way NET area, and consist of four parcels comprising
approximately 0.67acres, that is approximately 29,495 S.F.; located on the southwest corner at the
intersection of SW 8th Street and SW 12th Avenue consisting of lots 1, 2, and 4 Recorded on Plat Book 3,
page 33 (Complete legal description is on file with the Hearing Boards Section).
Review and analysis of the proposed application finds that:
• The subject properties are part of a commercial corridor designated T6-8-0 "Urban Core Transect
Zone - Open" and T4-L "General Urban Transect Zone — Limited" at the southwest corner of SW 8th
Street and SW 12th Avenue.
• The subject parcels abuts T6-8-0 to the north, northwest, and northeast and also abuts T4-R to the
south, southwest, and southeast.
• The requestis to change the zoning classifications for three parcels from T6-8-0 "Urban Core
Transect Zone - Open" and one parcel from T4-R "General Urban Transect Zone- Limited" to T5-0
"Urban Center Transect Zone - Open".
• Even though the proposed zoning change to T5-0 complies with Article 7, Amendment to the Miami
21 Code, 7.1.2.8 (a) successional zoning, it does not maintain the existing zoning continuity of the
T6-8-0 corridor along SW 8th Street.
• The Planning and Zoning Department recommends that the parcels currently zoned T6-8-0
maintain their existing zoning designation preserving the urban core corridor along SW 8th Street.
The Department also recommends that the southern parcel zoned T4-R experience a zoning
change to T4-0.
• The recommended zoning change to T4-0 allows transition between the two abutting parcels
zoned T4-R to the south and T6-8-0 to the north. The T4-0 permits less intrusive auxiliary
commercial use, specifically a bank drive -through by Warrant permit process, which could abut T4-
R parcel currently contain a multi -family commercial use.
• The recommended zoning designation of T4-0 will be consistent with the current Comprehensive
Neighborhood Plan (MCNP) designation of `Restricted Commercial" and would not require a
Future Land Use Map (FLUM) amendment.
• As mentioned, the requested zoning change from T6-8-0 to T5-0 would alleviate the continuity of
the T6-8-0 urban core corridor along SW 8th Street and it also would present the potential of an
more intense intrusive commercial use abutting the T4-R parcel.
Based on the aforementioned findings, the Planning Department recommends denial of the
application as presented.

Dear Mr. Rodriguez,
The undersigned is the authorized legal representative for Elias & Son Investments, Inc.,
Gustel Enterprises, Inc., Cristhel Enterprises, LLC. J. & J. Holdings, Inc., and Joaquin and
Carmen Alvarez (collectively referred to as "Owners"). The .Owners are the legal owners of four
(4) contiguous lots located on the southwest corner of the intersection of S.W. 8th Street and
S.W. 12t" Avenue. Three of the lots, 1208 SW 8" St, 1204 SW 8th Street and 810 SW 12
Avenue, are zoned T-6-80 ("Urban Core"). The last property, 832 SW 12 Ave, is zoned T4-R
("General Urban Zone"). This application seeks the rezoning of all properties to T5-O. This
request meets the requirement of Section 7.1.2.8 of the Miami Zoning Ordinance, ("Miami 21
Code"), in that the Property contains more than 200 lineal feet of frontage.
The requested zoning change is consistent with the designation for all of lots that
comprise the Property in the City's Comprehensive Neighborhood Plan, Future Land Use Plan.
The entire Property is designated General Commercial is the Future Land Use Plan map. The
requested rezoning of the properties to T5-O ("Urban Center") is consistent with the General
Commercial land use designation.
The Property is an important location at the intersection of two major thoroughfares in
the City, SW 8th Street at the heart of "Calle Ocho" and SW 12t1, Avenue, also in the heart of
Little Havana. This area is undergoing some urban transformation as new retail developments

are planned to serve the long underserved residential areas of Little Havana. This application
seeks the rezoning of the Property to develop this important, but long neglected corner, with a
retail bank facility with drive through lanes.
As stated in the rezoning statement that accompanies the application, the requested
zoning to T5-O is an appropriate transition between the abutting properties zoned T6-O along the
SW 8t1' Street commercial corridor and the properties zoned T4-R to the south. In fact, this
zoning transition pattern mirrors the zoning pattern established with Miami 21 on the northern
section of the intersection of SW 8t' Street and SW 12 Avenue. Specifically, the SW 8th
properties, which are zoned T6-8 0 are followed by properties zoned T5-0 and subsequently
transitions to T4-R. The proposed bank facility with drive through will conform with the site
plan, design and traffic circulation criteria established in Miami 21.
Based on the foregoing, we respectfully request the favorable review and
recommendation by the Planning Director.

STAFF, BOARDS, COMMITTEES AND THE CITY COMMISSION. A COPY OF SAID

• Requested Zoning: T5-O
Approximately two thirds of the assembled properties are proposed to be downzoned.
Rezoning to a less intense category is permitted by Miami 21.
❖ The Miami Comprehensive Neighborhood Plan, designates all the lots, (the "Property")
for General Commercial. The requested T5-0 zoning is consistent with this Land Use
Category.
❖ One lot is proposed to be rezoned from T4 to T5, which is permitted according to the
successional zoning guidelines established in Miami 21.
+ The assembled properties meet the minimum criteria for rezoning application established
in Section 7.1.2.8 in that it has more than 200 linear feet of frontage.
❖ The existing rezoning pattern in this intersection transitions from T6-80 to T4-L
❖ The proposed rezoning will establish a transition from T6 on the north side of SW 8th
Street to T5 and then T4. This is an appropriate transition.
•A The assembled properties are planned to be developed as a one story retail bank branch
with drive through facilities. The property currently zoned T4-L, will be used for
offstreet parking and drive through lanes, a less intense development than a 4 story
structure. On the corner of SW 8th Street and SW 12 Avenue, any potential development
will be limited to a maximum of 5 stories, which is lower and less intense than the
permitted "as of right" development under the existing T6-80 zoning.
The proposed development will improve this important corner in the Little Havana area
with a modern, attractive new bank facility.
