Unfortunately, Mr. Rodriguez said that he could not accept the appeal because it was untimely, under Section 23-4(c)(7), since the time period to appeal the oral HEP Board decision commenced April 3rd, and accordingly the fifteen (15) day time period to file a notice of appeal expired April 18, 2012. However, I am also attaching hereto a copy of the correspondence from Alexander Adams, the Preservation Officer, dated April 5, 2012, enclosing the written HEP Resolution of the April 3, 2012 meeting. I am unaware of any civil rule of civil procedure or statute, state or federal, in the State of Florida which sets forth a time period that commences any other time other than the entry of a written order or decision. This is the law and procedure because without a written decision, there is no precise or concrete decision to review or appeal. Furthermore, there have been numerous occasions where the oral decision made by the HEP Board have been in dispute and reduced to writing and the actual written approval had to be modified and/or amended, as I am sure you are well aware. Accordingly, I respectfully request that this appeal be accepted as timely upon receipt of this correspondence, please call me so that we may discuss this matter so that I may proceed accordingly. A six inch (6") capstone on the columns, made of honed Corintian granite to match the column base. g. 3. My home is located on a 30,000 square foot lot located in Morningside at 5901 North Bayshore Drive. It is a corner lot and the public street on the south side of my property runs all the way to the bay and there is a cul de sac at the end of 59th Street and Biscayne Bay where people congregate at all times of the day and night, whether it be fishing, drinking and conducting illegal activities. The pool deck behind my home is raised two feet above ground/street level to allow for appropriate drainage, which means when you are standing on my pool deck looking south with a six foot wall in between my property and the public street, it is the equivalent of having only a four foot wall because of elevation. To compound matters, approximately five years ago the sea wall at the end of 59th Street and the bay was repaired by the county/city and they raised the sea wall approximately 10-11 inches above the sidewalk elevation. I have a wife and two young children and I am extremely concerned about their safety, welfare and do not want people looking into my backyard while my children are in the pool with my wife, much less looking directly in through our back windows and large sliding glass doors over a 6 foot wall which has the equivalent of only a few feet. When I moved into this house in 1995, there was an eight or 9 foot fence with 14 foot hedges. We have now removed the hedges and the old wooden fence to make an aesthetically pleasing wall and we request that the concrete wall be allowed to have a height of 7 feet with piers allowed to go to the height of 7' 10". This project is asking to transform a contributing colonial architecture home into a more modern proposal today. Several distinguishing features are proposed to be eliminated or modified including: front porch columns, final trim, soffits, color, finish materials, new roof, new windows, doors, larger south privacy wall, second floor balconies on the south and east elevations, revisions on the east facade, an extension onto a eastern balcony, the removal of all colonial shutters, windows, columns, and trim. The last addition is a pool Cabana along northern property line. ANALYSIS This Colonial Revival Morningside contributing property was built in 1942. The colonial revival style was a prevalent American single family home type with traditional features of American founding colonies. Major features of the colonial style used in American colonies and Bahamian colonies were shutters, colonial divided light window panes, classical - style, applied wood accent trim details around windows and doors, restrained classical porch columns, simple building structure shapes with clean clear lines and symmetry of design. In June 2007 the owner came to the HEP Board for the approval of a master bedroom extension on the south end of the existing building, as well as alterations to the original home. These alterations included a new second story and extended rear balcony with spiral stair access on the northern end. The 2007 resolution (HEPB-2007-30) was approved with the following conditions: 1.The new addition except for the staircase should be stepped back at least two feet. 2.The windows on the south facade should be moved closer to the rear facade. 3.The railing drawing, as indicated on the south facade, should be incorporated into the final design. In 2011 the applicant returned to reactivate the prior permit and make a few renovations. After numerous meetings with the Preservation Office, on June 29, 2011 the Preservation Office agreed to allow the new master bedroom addition to have clear glass windows facing the bay. At this time, the Preservation Office also approved alterations to the historic portions of the home, including replacing the second floor rear windows with full length French doors and shutters. The Preservation Office also approved further detailing to the metal railings to accentuate the square inlet that mimics the original concrete block decorative railings. Today the applicant is requesting changes to the approved addition, including a contemporary design for the windows and the window April 3, 2012 Page 1 of 2 ITEM 1 — Old Business surrounds, adding a granite veneer along the base of the addition, and extending a balcony off the south facade. The applicant also proposes raising the south privacy wall to six feet (6') with six foot eight inch (6'8") piers. In addition, the applicant proposes a cabana with a flat roof and Bahamian -style shutters. Most importantly, however, the applicant proposes a drastic renovation to the historic portion of the home. The proposed redesign seriously alters or entirely removes most of the character - defining features of the original 1942 home, including: the four front porch columns, all colonial details around the windows and doors (including shutters and pediments), all colonial windows, and the original white flat tile roof. In addition, the applicant proposes adding brown stucco trim around all windows and doors, and adding a granite veneer along the base of the home. None of these alterations are characteristic of Colonial Revival Homes and would change the character of this home to a non- contributing resource. RECOMMENDATION The Preservation Office recommends that the current proposal be approved with conditions in accordance with the Secretary of the Interior's Standards, Chapter 23 of the Miami City Code, and the Morningside Design Guidelines. The Conditions are as follows: 1. The remaining portions of the original 1942 home shall retain the original Colonial Revival design and detailing, as approved by the HEPB in 2007 and Preservation staff in 2011. This includes columns, shutters, Colonial -style windows and doors, window and door pediments, and roof. If elements of these facades must be repaired or replaced, all new work must match the existing, in keeping with the Secretary of the Interior's Standards for Rehabiliation. 2. The proposed balcony on the south facade of the addition shall project no more than three feet (3') from the wall. This measurement shall be made from the outside wall of the house to the balcony railings. 3. The south privacy wall shall be no more than six feet (6') tall, in accordance with the Miami 21 zoning code and the Morningside Historic District Design Guidelines. 4. The columns of the proposed cabana shall reflect the design and detailing of the 1940s columns on the main house, with elongated proportions and a simple capital and base.
