HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-00622 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A LETTER AGREEMENT DETAILING WATER AND SEWER CONNECTION REQUIREMENTS, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE MIAMI-DADE COUNTY WATER AND SEWER DEPARTMENT, AS A CONDITION FOR WATER AND SEWER FACILITIES TO SERVE MOORE PARK; ALLOCATING FUNDS, IN THE AMOUNT OF $15,280.14, FROM CAPITAL IMPROVEMENT PROJECT NO. B-35887, FOR SAID PURPOSE. WHEREAS, the Moore Park project includes the new construction of a 2,981 square feet school daycare and a 15,894 square feet convention center located at 765 Northwest 36th Street, Miami, Florida; and WHEREAS, the Miami -Dade County Water and Sewer Department ("County") has requested the execution of a Letter Agreement as a condition for water and sewer facilities to serve Moore Park; and WHEREAS, said Letter Agreement requires that the City of Miami ("City") connect to the existing twenty (20) inch water main located within. the property for water service and to the existing eight (8) inch gravity sewer main located in Northwest 36th Street, Miami, Florida, abutting the southern boundary of the property; and WHEREAS, the City is required to pay combined water and sewer connection charges in an amount not to exceed $15,280.14 based on the average daily gallonage of 2,186 gallons for the proposed development use; and WHEREAS, funds are to be allocated from Capital Improvement Project No. B-35887, for said purpose; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section .2. The City Manager is authorized{1} to execute a Letter Agreement detailing water and sewer connection requirements, in substantially the attached form, with the County, as a condition for water and sewer facilities to serve Moore Park, with funds, in the amount of $15,280.14, allocated from Capital Improvement Project No. B-35887, for said purpose. . Section 3. BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
