A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A JOINT PARTICIPATION
AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE BAYFRONT
PARK MANAGEMENT TRUST ("TRUST"), FOR THE BAYFRONT PARK PIER
REPAIRS PROJECT ("PROJECT"); ACCEPTING THE CONTRIBUTION OF FUNDS
FROM THE TRUST, IN AN AMOUNT NOT TO EXCEED $300,000, FOR SAID
PROJECT.
WHEREAS, the Bayfront Park Management Trust ("Trust") and the City of Miami ("City") wish to
facilitate repairs to the existing piers located at Bayfront Park; and
WHEREAS, the Bayfront Park Pier Repairs Project ("Project") scope includes, but is not limited to:
replacing the deck and railing, and repairing the mooring hardware and fenders at the three (3)
courtesy piers, and providing shore power to the southernmost pier; and
WHEREAS, the Trust wishes to utilize the resources of the City in order to design, contract,
construct and administer the Project; and
WHEREAS, the attached Joint Participation Agreement ("JPA") has been negotiated between the
City and the Trust, detailing the responsibilities of the parties; and
WHEREAS, funds are to be appropriated by a separate resolution;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. The City Manager is authorized {1} to execute a JPA, in substantially the attached
form, with the Trust, for Project, accepting the contribution of funds from the Trust, in an amount not
to exceed $300,000, for said Project.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
