WHEREAS, pursuant to Resolution No. 04-0374, adopted June 10, 2004, the City Commission adopted the City of Miami's ("City") Five Year Consolidated Plan re-establishing eight (8) Neighborhood Development Zones in the City; and WHEREAS, the City Commission identified the Model City Community Revitalization Zone ("Zone") as one of the areas to undergo comprehensive redevelopment; and WHEREAS, the City and the Model City Community Revitalization Trust ("Trust") entered into an interlocal cooperation agreement ("Agreement"), dated September 23, 2003, to set forth the cooperative relationship between the City and the Trust and the respective duties, obligations and procedures to be followed by the parties for planning and implementation of revitalization efforts for the redevelopment of the Zone and for the conveyance of certain City -owned parcels of land to the Trust; and City of Miami Page 1 of 3 File Id: 05-00536 (Version: 1) Printed On: 4/17/2012 File Number: 05-00536 Enactment Number: R-05-0357 WHEREAS, in order to expedite the redevelopment of the Zone, the Trust by Resolution, at its May 16, 2005 meeting, authorized the City to convey certain parcels, currently subject to conveyance to the Trust pursuant to the Agreement directly to the Developers, as described in "Attachment A," attached hereto, for the construction of affordable housing and to the City Department of Off -Street Parking ("DOSP") and further amend the Agreement to provide for the deletion of such Tots from Exhibit "A" of the Agreement and as otherwise required; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to: (a) convey, with parcel reverter provisions, eleven (11) parcels of City -owned land directly to the Developers, as described in "Attachment A," attached and incorporated, for the construction of affordable housing for eligible low and moderate income persons, (b) convey certain City -owned parcels of land directly to the DOSP, as described in "Attachment B," attached and incorporated, for the construction of parking lots, currently subject to assignment to the Trust pursuant to the Agreement between the Trust and the City dated September 25, 2003, and (c) amending the Agreement to reflect: (1) the conveyance of eleven (11) parcels directly to the Developers for the construction of affordable housing, (2) the conveyance of certain parcels to DOSP for the construction of parking lots, and (3) the conveyance of five (5) parcels to Palmetto Homes of Miami, Inc., as described in "Attachment C," attached and incorporated, for the construction of affordable housing approved by the City Commission at its April 28, 2005 meeting, subject to the following terms: (1) the terms of the conveyances to the Developers will be subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u (Section 3), (2) the Developers will work with the President/CEO of the Trust to identify qualified local members of the Zone, particularly residents of the 33142 zip code, to work on the construction of the homes on a priority basis, (3) the first priority homebuyers for the proposed homes will be individuals and families displaced from theCity's Miami Limited Buildings, and (4) the sales price of the homes must comply with the affordable housing sales price approved by the City Commission. Section 3. The City Manager is further authorized{1} to execute the necessary documents, for said purpose. Section 4. Resolution No. 05-0357, adopted May 26, 2005, is amended by amending the attachment hereto, to reflect that the parcel of land conveyed to Miami Dream Home Investment Group, Inc., located at 1525 Northwest 60 Street, Miami, Florida, will be developed as a new construction multi -family rental project consisting of seven (7) units for low income persons, as specified in "Attachment A," attached and incorporated, and clarifying that said property will be conveyed to the City upon issuance of a certificate of occupancy for said project. ("Miami Dream Homes") by Quit Claim Deed dated September 27, 2005 and Corrective Quit Claim Deed dated July 5, 2006; and WHEREAS, due to the delay in obtaining permits from the Department of Water and Sewer and the Department of Environmental Resource Management, Miami Dream Homes was unable to start construction as required by the quit claim deeds; and WHEREAS, the Administration recommends modifying the Corrective Quit Claim Deed to Miami Dream Homes to provide that construction on the Properties of one (1) single family home must commence no later July 1, 2007; and WHEREAS, the Administration also recommends confirming that title to the property located at 1477 Northwest 60 Street Miami, Florida, previously conveyed to Miami Dream Homes, has reverted to the City; Ci y of Miami Page 1 of 3 R-07-0133 File Number: 07-00306 Enactment Number: R-07-0133 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The modification of Condition/ Restriction No. 5 of the Corrective Quit Claim Deed dated July 5, 2006, from the City to Miami Dream Homes, to provide that construction of one (1) single family home on the property listed on Exhibit "A," attached and incorporated, must commence no later than July 1, 2007, is approved. Section 3. It is in the intention of the City Commission that title to the parcels described in Exhibit "A," attached and incorporated, except for the parcel located at 1477 Northwest 60 Street Miami, Florida, shall be deemed to have remained in Miami Dream Homes from the date of conveyance, and that the extension of time granted herein to commence construction shall be deemed to have been made on or before January 5, 2007. Section 4. The reversion of title to City of the parcel of land located at 1477 Northwest 60 Street Miami, Florida, listed in Exhibit "B," attached and incorporated, is confirmed. Section 5. The City Manager is authorized {1} to execute all necessary documents for said purpose. Section 6. ("Miami Dream Homes"), by quit claim deed dated September 27, 2005, for the construction of affordable single family homes, and WHEREAS, pursuant to Resolution No. 06-0329, adopted May 25, 2006, the City Commission approved one parcel, located at 1525 Northwest 60th Street, Miami, Florida, to be developed as a new construction multi- family rental project consisting of seven (7) units for low income persons; and WHEREAS, pursuant to Resolution No. 07-0133, adopted March 08, 2007, the City; Commission approved the modification of condition/restriction No. 5 of the corrective quit claim deed, dated July 5, 2006, from the City to Miami Dream Homes to provide that construction on the Properties of one of the single family homes must commence no later than July 1, 2007; and WHEREAS, due to issues with architect and engineering companies, and extensive delays in obtaining permits due to new permit requirements in the development district, Miami Dream Homes was unable to complete the multi -family rental project on the parcel located at 1525 Northwest 60th Street, Miami, Florida, in the timeframe required; and WHEREAS, due to Miami -Dade County policy changes that gave priority to the Dade County infill program, Miami Dream Homes experienced delays on the parcels located at 1533 Northwest 58th Terrace, 1543 Northwest 59th Street, 1600 and 1610 Northwest 60th Street and 6020 Northwest 15th Avenue, Miami, Florida; and WHEREAS, Miami Dream Homes has completed and sold the single family homes on the City of Miami Page 1 oft File Id: 08-00433 (Version: 2) Printed On: 8/29/2011 File Number: 08-00433 Enactment Number: R-08-0250 parcels located at 1535_and 1545 Northwest 58th Terrace, Miami, Florida; and WHEREAS, Miami Dream Homes has resolved all issues and is ready to complete both the single family homes and the multi -family rental project; and WHEREAS, the Administration recommends granting Miami Dream Homes an extension of time until April 30, 2009, for Miami Dream Homes to complete the affordable housing construction projects on the Properties listed in Exhibit "A", and for the conveyance of the mufti -family rental project to the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1.
