A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO GRANTALLAPATTAH BUSINESS
DEVELOPMENT AUTHORITY, INC. ("ABDA"), AN EXTENSION OF TIME TO
COMMENCE CONSTRUCTION FROM JANUARY 1, 2012 TO OCTOBER 1, 2012,
AND TO COMPLETE CONSTRUCTION FROM JUNE 30, 2012 TO MARCH 31,
2013, ON THE PROPERTIES LOCATED AT 790-92 NORTHWEST 29TH TERRACE,
MIAMI, FLORIDA, AND AN EXTENSION OF TIME TO COMMENCE
CONSTRUCTION FROM JULY 1, 2012 TO APRIL 1, 2013, AND TO COMPLETE
CONSTRUCTION FROM DECEMBER 30, 2012 TO OCTOBER 31, 2013 ON THE
PROPERTIES LOCATED 3255-57 NORTHWEST 11TH COURT AND 3245-47
NORTHWEST 11TH COURT, MIAMI, FLORIDA (COLLECTIVELY THE
"PROPERTIES"), LEGALLY DESCRIBED IN EXHIBIT "A," ATTACHED AND
INCORPORATED; AUTHORIZING THE CITY MANAGER TO MODIFY THE
PROJECT FROM AFFORDABLE HOMEOWNERSHIP TO AFFORDABLE RENTAL;
FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE MODIFICATIONS
TO THE DEED(S) THAT CONVEYED THE PROPERTIES FROM THE CITY OF
MIAMI TO ABDA, AND ALL OTHER NECESSARY DOCUMENTS, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSES.
WHEREAS, pursuant to Resolution No. 04-0289, adopted May 6, 2004, the Miami City
Commission designated certain City of Miami ("City") owned properties located at 3245 Northwest
11th Court, 3255 Northwest 11th Court, and 1264 Northwest 31st Street, Miami, Florida, as surplus
and authorized Allapattah Business Development Authority, Inc ("ABDA") to develop three (3) twin
homes for affordable to very low, low or moderate -income families or individuals; and
WHEREAS, pursuant to Resolution No. 07-0490, adopted September 11, 2007, the Miami City
Commission granted ABDA an extension until March 30, 2008, to commence construction on the
properties located at 1264 Northwest 31 st Street, 3245 Northwest 11th Court, 3255 Northwest 11th
Court and 790 Northwest 29th Terrace, Miami, Florida, authorized the construction of a twin home
rather than a single family home, on the property located at 790 Northwest 29th Terrace, Miami,
Florida, and further granted an extension until December 31, 2008, to complete construction of a twin
home on each property; and
WHEREAS, pursuant to Resolution Nos. 08-0251, 09-0028 and 11-0120, adopted May 8,
2008, January 15, 2009 and March 24, 2011, respectively, the Miami City Commission approved
various extensions for the commencement and completion of construction dates for the properties
located at 3245 Northwest 11th Court, 3255 Northwest 11th Court, 3245 Northwest 11th Court, Miami,
Florida, to July 1, 2012 and for the property located at 790 Northwest 29th Terrace, Miami, Florida to
June 30, 2012; and
WHEREAS, due to the current economic climate, ABDA has requested to allow for the
construction of duplexes for rent on the infill lots rather than twin homes to be sold to individual

buyers; and
WHEREAS, the City Administration recommends granting ABDA an extension of time to
commence construction from January 1, 2012 to October 1, 2012, and to complete construction from
June 30, 2012 to March 31, 2013, on the properties located at 790-92 Northwest 29th Terrace, Miami,
Florida, and an extension of time to commence construction from July 1, 2012 to April 1, 2013, and to
complete construction from December 30, 2012 to October 31, 2013 on the properties located
3255-57 Northwest 11th Court and 3245-47 Northwest 11th Court, Miami, Florida, legally described in
Exhibit "A," attached and incorporated; and
WHEREAS, the City Administration further authorizes the City Manager to modify the project
from affordable homeownership to affordable rental for the lots located at 790 Northwest 29th
Terrace, 3245 Northwest 11th Court and 3255 Northwest 11th Court, Miami, Florida;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as fully set forth in this Section.
Section 2. The City Manager is authorized{1 } to grant ABDA an extension of time to
commence construction from January 1, 2012 to October 1, 2012, and to complete construction from
June 30, 2012 to March 31, 2013, on the properties located at 790-92 Northwest 29th Terrace, Miami,
Florida, and an extension of time to commence construction from July 1, 2012 to April 1, 2013, and to
complete construction from December 30, 2012 to October 31, 2013 on the properties located
3255-57 Northwest 11th Court and 3245-47 Northwest 11th Court, Miami, Florida, legally described in
Exhibit "A," attached and incorporated.
Section 3. The City Manager is authorized{1} to modify the project from affordable
homeownership to affordable rental for the lots located at 790 Northwest 29th Terrace, 3245
Northwest 11th Court and 3255 Northwest 11th Court, Miami, Florida.
Section 4. It is the intention of the Miami City Commission that title to the parcels described
above and in Exhibit "A," attached and incorporated, shall be deemed to have remained in ABDA from
the date of conveyance.
Section 5. The City Manager is further authorized {1} to execute any required modifications to
the deed(s) that conveyed the properties from the City to ABDA, and all necessary other documents,
in a form acceptable to the City Attorney, for said purpose.
Section 6. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor. {2}

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10)
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by the City Commission.
