Subject: Execute - Off -System Construction and Maintenance Agrmt - State Rd 953
Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), authorizing the City
Manager to execute an Off -System Construction and Maintenance Agreement, in
substantially the attached form, with the State of Florida Department of Transportation
("FDOT"), for improvements on State Road 953 / SW -NW 42 Avenue from north of SW
8 Street to south of NW 11 Street, Miami, Florida, for general roadway improvements in
this corridor, including improvements on roads not on the State Highway System.
Background of Item:
FDOT has developed design plans Financial Management Project No. FM 447809-1-
52-01 for State Road 953 / SW -NW 42 Avenue from north of SW 8 Street to south of
NW 11 Street, for the milling and resurfacing of the existing asphalt pavement,
replacement of substandard pedestrian ramps, modifications to median access at SW 5
Terrace, SW 4 Street, SW 3 Street, SW 2 Terrace and SW 2 Street, miscellaneous
drainage improvements, upgrading signing and pavement markings, replacing
signalization loops with video detection, replace the signal mast arm at the northeast
corner of West Flagler Street, replace the signal controller cabinet at the mid -block
crossing at NW 2 Street, retrofit lighting system at the NW 7 Street intersection and
relocate palms on medians due to median access modifications. The Off -System
Construction and Maintenance Agreement attached as Exhibit "A", establishes the
terms, conditions, and responsibilities of FDOT and the City to accomplish the Project
and Local Roadway Improvements on the City's Streets. The City agrees with the terms
and conditions in the Agreement, in substantially the attached form.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AN OFF -SYSTEM
CONSTRUCTION AND MAINTENANCE AGREEMENT, IN SUBSTANTIALLY THE
ATTACHED FORM, WITH THE STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION ("FDOT"), FOR IMPROVEMENTS ON STATE ROAD
953/SOUTHWEST-NORTHWEST 42 AVENUE FROM NORTH OF SOUTHWEST 8
STREET TO SOUTH OF NORTHWEST 11 STREET, MIAMI, FLORIDA, FOR
GENERAL ROADWAY IMPROVEMENTS IN THIS CORRIDOR, INCLUDING
IMPROVEMENTS ON ROADS NOT ON THE STATE HIGHWAY SYSTEM.
WHEREAS, the Florida Department of Transportation ("FDOT") has developed design
plans Financial Management ("FM") Project No. FM 447809-1-52-01 for State Road ("SR")
953/Southwest-Northwest 42 Avenue from north of Southwest 8 Street to south of Northwest 11
Street, for the milling and resurfacing of the existing asphalt pavement, replacement of
substandard pedestrian ramps, modifications to median access at Southwest 5 Terrace,
Southwest 4 Street, Southwest 3 Street, Southwest 2 Terrace and Southwest 2 Street,
miscellaneous drainage improvements, upgrading signing and pavement markings, replacing
signalization loops with video detection, replace the signal mast arm at the northeast corner of
West Flagler Street, replace the signal controller cabinet at the mid -block crossing at Northwest
2 Street, retrofit lighting system at the Northwest 7 Street intersection and relocate palms on
medians due to median access modifications ("Project"); and
WHEREAS, FDOT intends to undertake and complete the Project, a portion of which
includes work on roads not on the State Highway System but City of Miami ("City") right-of-way,
specifically on Southwest 7 Street, approximately 6' west and 7' east measured from the point of
tangency ("PT") of the curb return radius, Southwest 6 Street, approximately 10' west and 22'
east from the PT of the curb return, Southwest 5 Terrace, approximately 7' west and 8' east
from the PT of the curb return, Southwest 5 Street, approximately 9' west from the PT of the
curb return, Southwest 4 Street, approximately 8' west and 25' east from the PT of the curb
return, Southwest 3 Street, approximately 8' west from the PT of the curb return, Southwest 2
Terrace, approximately 7' west and 8' east from the PT of the curb return, Southwest 2 Street,
approximately 7' east from the PT of the curb return, Northwest 1 Street, approximately 128'
west from the PT of the curb return, Northwest 2 Street, approximately 9' west and 10' east from
the PT of the curb return, Northwest 2 Terrace, approximately 11' west from the PT of the curb
return, Northwest 3 Street, approximately 60' west and 37' east from the PT of the curb return,
Northwest 4 Street, approximately 7' west and 13' east from the PT of the curb return,
Northwest 4 Terrace, approximately 8' east from the PT of the curb return, Northwest 5 Street,
approximately 10' west and 13' east from the PT of the curb return, Northwest 6 Street,
approximately 8' west and 9' east from the PT of the curb return, and Northwest 9 Street,
approximately 16' east from the PT of the curb return (for purposes of this agreement, the "Off -
System Project Limits"); and
WHEREAS, the Project includes pavement restoration through milling and resurfacing
of the existing asphalt pavement, and installation of new pavement markings, minor roadway
reconstruction, replacement of sidewalks and pedestrian ramps, installation of pull boxes and
signalization conduits and replacement of the lighting service disconnect at Northwest 1 Street
("Local Roadway Improvements") and all activities associated with, or arising out of the
construction of the Local Roadway Improvements; and
WHEREAS, the Off -System Construction and Maintenance Agreement ("Agreement"),
attached and incorporated as Exhibit "A," establishes the terms, conditions, and responsibilities
of FDOT and the City to accomplish the Project and Local Roadway Improvements on the City's
Streets; and
WHEREAS, the City agrees with the terms and conditions in the Agreement, in
substantially the attached form;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute an Agreement, in substantially
the attached form, with FDOT, for the Project on SR 953/Southwest-Northwest 42 Avenue from
north of Southwest 8 Street to south of Northwest 11 Street, Miami, Florida, which includes
improvements on roads not on the state highway system, and the Local Roadway
Improvements.
Section 3. This Resolution shall become effective immediately upon its adoption.
