HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-00461 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXERCISE RENEWAL OPTIONS UNDER THE SOFTWARE MAINTENANCE AND SUPPORT SERVICES AGREEMENT BETWEEN THE CITY OF MIAMI AND TIBURON, INC., PURSUANT TO RESOLUTION NO. 04-0490, ADOPTED JULY 22, 2004, FOR THE PROVISION OF SOFTWARE MAINTENANCE AND SERVICES FOR THE DEPARTMENT OF FIRE -RESCUE, RETROACTIVELY FOR YEARS 2009 THROUGH 2011 AND THEREAFTER, FORA PERIOD OF FIVE (5) YEARS, AT THE RATES PROVIDED IN ATTACHMENT "A", WITH AN OPTION TO ADD ADDITIONAL YEARS AT A RATE ACCEPTABLE TO THE CITY MANAGER. WHEREAS, pursuant to Resolution No. 04-0490, adopted July 22, 2004, the City of Miami ("City") entered into an agreement with Tiburon, Inc. ("Tiburon"), pursuant to Request for Proposals No. 22009530, for the acquisition of a new Public Safety Records Management System ("RMS"); and WHEREAS, the agreement contemplated an ongoing renewal period that would only terminate when the agreement is cancelled by either party, but Resolution No. 04-0490, only authorized four (4) renewals of the Agreement through July 29, 2009; and WHEREAS, based on ease of use and scalability, the Tiburon RMS program improves the reliability of the system and provides the City with a technology that enables the revitalized system to have a life expectancy well into the next decade, and will ensure the continued safety of the City's firefighters, police officers and residents; and WHEREAS, the City wishes to renew the Software Maintenance and Support Services Agreement ("Agreement") between the City and Tiburon for the Department of Fire -Rescue; and WHEREAS, the first year amount for the service will not exceed $45,610, with yearly increases for each of the subsequent option periods; and WHEREAS, funds are available for the first year contract term and will be allocated from Information Technology Budget Account No. 00001.251000.546000.0000,00000; and WHEREAS, the authority to renew the Agreement will apply retroactively from 2009 and continue in effect until terminated pursuant to the terms of the Agreement; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. The City Manager is authorized{1} to exercise renewal options under the Agreement between the City and Tiburon,pursuant to Resolution No. 04-0490, adopted July 22, 2004, for the provision of software maintenance and services for the Department of Fire -Rescue; retroactively for years 2009 through 2011 and thereafter, for a period of five (5) years, at the rates provided in Attachment "A", with an option to add additional years at a rate acceptable to the City Manager. Section 3. This Resolution shall become effective immediately upon its adoptioh and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS JULIE 0. BRU L 1�� CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution; it shall become effective immediately upon override of the veto by the City Commission.
