HomeMy WebLinkAboutR-12-0189City of Miami Legislation Resolution: R-12-0189 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-00382 Final Action Date: 5/10/2012 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE TRANSFER OF COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS IN THE AMOUNT OF $500,000 FROM THE DISTRICT 4 ECONOMIC DEVELOPMENT RESERVE ACCOUNT; ALLOCATING SAID FUNDS TO THE CITY OF MIAMI OFFICE OF THE CAPITAL IMPROVEMENTS PROGRAM FOR STREET IMPROVEMENTS IN THE WEST FLAGLER AREA, MIAMI, FLORIDA; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 11-0119, adopted March 24, 2011, the Miami City Commission approved the allocation of $848,935 to the District 4 Economic Development Reserve Account; and WHEREAS, the Office of the Capital Improvements Program ("CIP") is responsible for the planning, coordination, implementation, and monitoring of all construction related capital projects in the City of Miami ("City"), and for the financial management of all capital funds; and WHEREAS, there is a need to replace portions of the roads in the West Flagler area of District 4 on Southwest 4th Street to Southwest 8th Street and Southwest 32nd Avenue to Southwest 27th Avenue, Miami, Florida ("West Flagler area"), which are deteriorated or defective and need rehabilitation which will include resurfacing, drainage improvements, sidewalk, curb and landscape enhancements; and WHEREAS, the West Flagler area qualifies as a Low -Income community and the street improvement qualifies for Community Development Block Grant ("CDBG") funding as improvement to public facilities; and WHEREAS, the City Administration recommends the allocation of CDBG funds in the amount of $500,000 from the District 4 Economic Development Reserve Account to CIP for public facilities and improvement activities for street improvements in the West Flagler area; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The transfer of CDBG funds, in the amount of $500,000 from the District 4 Economic Development Reserve Account to CIP, is authorized, with funds allocated to the City's Office of the CIP for street improvements in the West Flagler area. The City Manager is authorized{1} to execute all necessary documents, in a form acceptable to the City Attorney for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
