Background of Item: FDOT has developed design plans Financial Management Project No. FM 445999-52- 01 for State Road ("SR") 7 / NW 7 Avenue from north of NW 3 Street to south of NW 8 Street, for the milling and resurfacing of the existing asphalt pavement, correcting of pavement failures, upgrading of deficient pedestrian ramps, replacement of damaged sidewalks, upgrading of signs and pavement markings, installation of pedestrian signals, pedestrian detectors, electrical service point and service disconnect, installation of retroreflective backplates, and installation of pedestal with blank -out sign at NW 6 Street (Project 1). FDOT has also developed design plans Financial Management Project No. FM 449363-52-01 for State Road ("SR") 933 / NW 12 Avenue at NW 6 Street, for the milling and resurfacing of the existing asphalt pavement, upgrading of deficient pedestrian ramps, upgrading of signs and pavement markings, and installation of pedestrian signals and detectors ("Project 2"). The Off -System Construction and Maintenance Agreement attached and incorporated, establishes the terms, conditions, and responsibilities of FDOT and the City to accomplish the Project and Local Roadway Improvements on the City's Streets. WHEREAS, the Florida Department of Transportation ("FDOT") has developed design plans Financial Management ("FM") Project No. FM 445999-52-01 for State Road ("SR") 7 / Northwest 7 Avenue from north of Northwest 3 Street to south of Northwest 8 Street, for the milling and resurfacing of the existing asphalt pavement, correcting of pavement failures, upgrading of deficient pedestrian ramps, replacement of damaged sidewalks, upgrading of signs and pavement markings, installation of pedestrian signals, pedestrian detectors, electrical service point and service disconnect, installation of retroreflective backplates, and installation of pedestal with blank -out sign at Northwest 6 Street ("Project 1"); and WHEREAS, FDOT intends to undertake and complete the Project, a portion of which includes work on roads not on the State Highway System but City of Miami ("City") right-of-way, specifically on Northwest 4 Street, from the Southwest corner radius return to 75 feet west along the street and sidewalk, Northwest South River Drive, from the Northwest corner radius return to 80 feet north along the street and sidewalk, Northwest 5 Street from the corner radius return to 330 feet east along the sidewalk, Northwest 6 Street from the corner radius return to 70 feet east along the street and sidewalk, and Northwest 7 Street from the Southwest corner radius return to 55 feet west of the sidewalk, and from the Northeast corner radius return to 65 feet east of the sidewalk (for purposes of this agreement, the "Off -System Project Limits") and WHEREAS, Project 1 includes pavement restoration through milling and resurfacing of the existing asphalt pavement, correcting of pavement failures, replacement of damaged sidewalks, upgrading of signs and pavement markings, installation of pedestrian signals, pedestrian detectors, installation of signalization components such as vehicle detector loops, conduits and pull boxes, installation of electrical service point and service disconnect ("Local Roadway Improvements") and all activities associated with, or arising out of the construction of the Local Roadway Improvements; and WHEREAS, the Florida Department of Transportation ("FDOT") has developed design plans Financial Management ("FM") Project No. FM 449363-52-01 for State Road ("SR") 933 / Northwest 12 Avenue at Northwest 6 Street, for the milling and resurfacing of the existing asphalt pavement, upgrading of deficient pedestrian ramps, upgrading of signs and pavement markings, and installation of pedestrian signals and detectors ("Project 2"); and WHEREAS, FDOT intends to undertake and complete the Project, a portion of which includes work on roads not on the State Highway System but City of Miami ("City") right-of-way, specifically on Northwest 6 Street (for purposes of this agreement, the "Off -System Project Limits") and WHEREAS, Project 2 includes pavement restoration through milling and resurfacing of the existing asphalt pavement, installation of pull boxes, underground conduits and upgrading of pavement markings ("Local Roadway Improvements") and all activities associated with, or arising out of the construction of the Local Roadway Improvements; and WHEREAS, the Off -System Construction and Maintenance Agreement ("Agreement"), attached and incorporated as Exhibit "A," establishes the terms, conditions, and responsibilities of FDOT and the City to accomplish the Project and Local Roadway Improvements on the City's Streets; and WHEREAS, the City agrees with the terms and conditions in the Agreement, in substantially the attached form; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized to execute the Agreement, in substantially the attached form, with FDOT, for the Projects on State Road ("SR") 7 / Northwest 7 Avenue from north of Northwest 3 Street to south of Northwest 8 Street, Miami, Florida (Project 1) and on State Road ("SR") 933 / Northwest 12 Avenue at Northwest 6 Street, Miami, Florida (Project 2), which include improvements on roads not on the state highway system, and the Local Roadway Improvements. Section 3. This Resolution shall become effective immediately upon its adoption.
