Chiaro, Deputy City Attomey7- DATE: April 27, 2012 RE: Scrivener's Error -April 26, 2012 City Commission Meeting Resolution No. 12-0173, relating to codesignations of streets by the Florida Legislature. File No. 12-00453 Please be advised that Resolution No. 12-0173, adopted April 26, scrivener's errors in the title and in the body of the legislation relating to c streets by the Florida Legislature. The spelling of Lourdes P. Aguila and the Florida Department of ("FDOT") District number were incorrect. The spelling has been changed from "Aguilla" to "Aguila" and FDOT's has been modified from "115" to "6" in the appropriate places. The attached Resolution has been modified to reflect these corrections whereas clause and in Section 2 of said Resolution. Attachment(s) 2012, contains odesignations of Transportation's District number in the title, first C) OR' CO, VIP City of Miami Legislation Resolution: R-12-0173 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-00453 Final Action Date: 4/26/2012 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), DECLARING NO OBJECTION AND SUPPORTING THE CODESIGNATIONS BY THE FLORIDA LEGISLATURE, PURSUANT TO HOUSE BILL 7039, DESIGNATING A PORTION OF U.S. HIGHWAY 41/STATE ROAD 90/SOUTHWEST 8TH STREET BETWEEN SOUTHWEST 10TH AVENUE AND STATE ROAD 933/SOUTHWEST 12TH AVENUE, MIAMI, FLORIDA, AS "BRIGADA 2506 STREET, CARLOS RODRIGUEZ SANTANA," AND A PORTION OF SOUTHWEST 12TH AVENUE FROM CORAL WAY TO SOUTHWEST 16TH STREET, MIAMI, FLORIDA, AS "LOURDES P. AGUILA STREET," FURTHER DIRECTING THE CITY MANAGER TO INSTRUCT THE DIRECTOR OF PUBLIC WORKS TO TRANSMITA COPY OF THIS RESOLUTION TO THE FLORIDA DEPARTMENT OF TRANSPORTATION, DISTRICT 6 AND ANY OTHER APPROPRIATE OFFICIALS, FOR SIGN INSTALLATION WITHIN THE NEWLY DESIGNATED ROADWAY. WHEREAS, House Bill 7039, adopted by the Florida Legislature, designated a state transportation facility ("roadway") that is located within the City of Miami ("City") a portion of U.S. Highway 41/State Road 90/Southwest 8th Street between Southwest 10th Avenue and State Road 933/Southwest 12th Avenue, Miami, Florida, as "Brigada 2506 Street, Carlos Rodriguez Santana; and a portion of Southwest 12th Avenue from Coral Way to Southwest 16th Street, Miami, Florida, as "Lourdes P. Aguila Street", and WHEREAS, Florida Statute 334.071, entitled "Legislative designation of transportation facilities," states that erection of markers shall be contingent upon the appropriate city or county commission passing a resolution in support of the particular honorary designation; and WHEREAS, pursuant to the request made by the Florida Department of Transportation ("FDOT") for honorary designation of roads located in the City, the Miami City Commission has no objections and supports House Bill 7039; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF NIIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The Miami City Commission declares no objection and supports the codesignations by the Florida Legislature, pursuant to House Bill 7039, designating a portion of U.S. Highway 41/State Road 90/Southwest 8th Street between Southwest 10th Avenue and State Road 933/Southwest 12th Avenue, Miami, Florida, as "Brigada 2506 Street, Carlos Rodriguez Santana; and a portion of Southwest 12th Avenue from Coral Way to Southwest 16th Street, Miami, Florida, as "Lourdes P. The City Manager is directed to instruct the Director of Public Works to transmit a copy of this Resolution to FDOT, District 6 and any other appropriate officials, for sign installation within the newly designated roadways. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} APPROVED AS TO FORM AND CORRECTNESS: CITY ATTORNEY Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
