A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING SEVERANCE
PAY TO ERNEST BURKEEN FOR HIS SEPARATION FROM SERVICE FROM THE
CITY OF MIAMI'S DEPARTMENT OF PARKS AND RECREATION, SUBJECT TO
HIS EXECUTION OF AN ACKNOWLEDGMENT, WAIVER AND RELEASE
AGREEMENT IN A FORM ACCEPTABLE TO THE CITY ATTORNEY.
WHEREAS, pursuant to Ordinance No. 13289, adopted October 13, 2011, the City Commission
approved conditions under which severance pay or leave may be granted to unclassified service
personnel appointed by the City Manager to positions holding executive status; and
WHEREAS, severance pay shall not be given if the employee, voluntary resigns, retires or the
employee is terminated for cause; and
WHEREAS, Ernest Burkeen was appointed to the executive status and served as the Director of
the Department of Parks and Recreation from May 31, 2004 until his separation from service on
March 9, 2012; and
WHEREAS, Ernest Burkeen is eligible to receive up to a maximum of 6 weeks of salary as
severance payment;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals contained in the Preamble to this Resolution are adopted by reference and
incorporated as fully set forth in this Section.
Section 2. Severance pay equal to week(s) of salary to Ernest Burkeen is authorized for
his separation from service from the City of Miami's Department of Parks and Recreation.
Section 3. Said severance pay shall not affect any pre-existing rights to accrued vacation and sick
time, and shall be subject to Ernest Burkeen's execution of an Acknowledgment, Waiver and Release
Agreement in a form acceptable to the City Attorney.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
