HomeMy WebLinkAboutR-12-0125City of Miami Legislation Resolution: R-12-0125 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-01196rw Final Action Date: 3/22/2012 A RESOLUTION OF THE MIAMI CITY COMMISSION MAKING FINDINGS AND APPROVING A WAIVER OF TIME LIMITS FOR CONSIDERATION BY THE PLANNING ZONING AND APPEALS BOARD ("PZAB") PURSUANT TO ARTICLE 7, ENTITLED "PROCEDURES AND NONCONFORMITIES", SECTION 7.1.2.8(G)(7) OF THE MIAMI 21 CODE, ALLOWING THE PZAB TO CONSIDER A CHANGE OF ZONING FOR A PROPERTY APPROXIMATELY LOCATED AT 150 NORTHEAST 42ND STREET, 135 NORTHEAST 41 ST STREET AND 115 NORTHEAST 41 ST STREET, MIAMI, FLORIDA, WHICH WERE REZONED WITHIN THE PRECEDING EIGHTEEN (18) MONTHS. WHEREAS, on September 30, 2011, Neisen O. Kasdin, Esquire, on behalf of FFAC, LLC (Del.), Begonia Holdings, LLC (Del.) and Dacra Design Moore, LLC (Del.), owners, has submitted a Special Area Plan ("SAP") application, pursuant to Article 3.9 of the Miami 21 Code; and WHEREAS, the subject properties, 150 Northeast 42nd Street, 135 Northeast 41st Street and 115 Northeast 41 st Street, Miami, Florida, is included in said SAP application; and WHEREAS, a portion of the subject properties were rezoned to its current designation of T4-O, within the preceding eighteen (18) months; and WHEREAS, City Commission approval is required to allow the Planning Zoning and Appeals Board ("PZAB") to consider the rezoning of the aforementioned properties within eighteen (18) months from the date of the prior rezoning; and WHEREAS, the City Commission deems it advisable and in the best interest of the general welfare of the City of Miami to approve the requested waiver to facilitate the redevelopment of the city in the context of the adopted Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission approves a waiver of time limits for consideration by the PZAB pursuant to Article 7, entitled "Procedures and Nonconformities", Section 7.1.2.8(g)(7) of the Miami 21 Code at 150 Northeast 42nd Street, 135 Northeast 41 st Street and 115 Northeast 41 st Street, Miami, Florida, which were rezoned within the preceding eighteen (18) months. Section 3. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
